Miss B is a 14 year old who is gardening supported by FairCop.

"Like many teenagers, Miss B. likes to discuss cultural issues with her friends and peers as part of a diverse and open school environment. However, the new APPHCG guidance from the College of Policing could see a “non-hate crime incident” recorded against her name, should a person to whom she is speaking – or a third party, such as a teacher or fellow pupil who did not even witness the incident – report her, however unfairly or mistakenly, for expressing hostile or prejudiced views. "

As the College of police are not appealing Harry Miller's win both Miss B and Sarah Phillimore can now proceed.

Sarah Phillimore's gardening is considering whether The police should not secretly record us as 'hateful'

Did you follow the Miller v College of Policing appeal? Read any articles after the recording of non-crime hate incidents were found to be unlawful?

Recording of so-called “non-crime hate incidents” by police forces in England is an unlawful interference with freedom of expression, the Court of Appeal has ruled.

The Home Office had also raised concerns, saying: “‘non-crime hate incidents’ have a chilling effect on free speech and potentially stop people expressing views legally and legitimately.

It's not hypothetical. The threat of police involvement is stopping people, including this girl, from expressing perfectly legal views.

BlueberryCheezecake I understand that a fun feature of this guidance is that there is absolutely no obligation on the police to inform the subject whether and when a non-crime hate incident had been recorded against their name, meaning that the subject is only likely to find out when it shows up on an enhanced DBS check if the police have chosen in their discretion to include it or if they are politically and legally savvy enough to submit a pre-emptive data subject access request to a given police force (as Sarah Phillimore did) or (to really know) to every police force in the country.

So when you say Miss B has "never experienced such an incident" and that it is "unlikely" to occur, I am curious to know how you reach that conclusion.

How many children have already been reported and recorded without their knowledge? No idea. They won't have been told, most will not yet have had caused to apply for an enhanced DBS check and will be extremely unlikely to regularly submit DSARs to their local police force just in case.

Bit of an issue if police decide in their discretion to include it on an enhanced DBS check when that child comes to apply for a job as a teacher or a carer, though, isn't it?

if you do a bit of reading around, the little we know of the young woman, girl, involved, she had very specific reasons for wanting to be heard. Given this update I doubt those reasons have gone away

I'm.always extremely confused about the double standards. How kids can apparently know exactly who amd what they are from. Toddlerhood. But teenagers simultaneously cannot know that something is wrong amd needs to be challenged legally and the adults around them.must be coaching/ encouraging them.

A teenager who, no doubt, is being fulled supported by their family is prepared to take a political stand and being questioned for their ability. Yet, we are told time and time again that children are to be celebrated for believing they can change sex and deny material reality.

I am sure that this teenager will have their identity protected. They will not be making permanent and irreversible changes to their body. They are also asking for a court to make a judgement, so asking for a chance to present their case.

Are they being manipulated to do this? I would hope not and that should be carefully and sensitively confirmed.

In saying that, I have a 15 year old that would fight for the freedom of speech too and has done so at their school regularly even at 14. They have been involved in bringing issues to the attention of the school for a few years.

To bring a court case to focus on the ramifications of “non-hate crime incident” reporting, is not outside the realm of a person of this age if they had the opportunity and support to do so.

Being told they have no choice but to undress and shower alongside teenaged males, because the teenaged males want it and have feelings,and the female children's feelings about it don't matter. They are much less important than the male ones, and their bodies are not theirs to control for their own privacy, dignity and comfort, their bodies are something male children have a right to make use of.

This. Why does a girl always have to suffer first due to these policies before we can act?

What I love about gardening @BlueberryCheezecake is that you start with your pretty barren patch of land where it looks like you have no chance of a single sprout surviving, then over time as you fertilise it & work the ground repeatedly the soil becomes richer until it's ready for your garden to thrive.

It doesn't matter if this time your plant doesn't grow, you are preparing the ground for the next plant to succeed or the plant after that until one day you have a garden bursting full of life.

A brief look around FWR would make it clear that it is happening. All the time.

This makes me so angry.

  • You're not allowed to complain about this male supremacism and biological disadvantage of being born female while the male people at the heart of it tell you that they want you to pretend that sex doesn't exist until you have absolute cast iron proof you have been harmed

  • Then we'll exclude you from services, tell you you're a bad person who doesn't deserve services for not making your life all about a male stranger who matters more than you do, and threaten to take action including police and a criminal record while refusing to record what happened to you

  • We'll tell you repeatedly that what happened to you, whatever it was, was not bad enough to justify anyone caring, and you probably deserved it for being traumatised/disabled/of the wrong faith/thinking you had rights

  • If you fuss and try to push this or go public, you risk a huge pile on and death threats (Hi JKR) and rape threats while we try and get you silenced

  • If you succeed in getting it to court, we'll get our rich lobby to fight on the grounds that males are much, much more important and you're a bad person with bad friends who has no rights in law anyway and ought to just be harmed quietly and appreciate it.

Just wtaf are people thinking here that they don't believe children should be allowed a voice to stand up to policies that harm them ?

It's flat out male supremacism. Covered with a police enforced demand not to mention that it's bleeding obvious sex exists and doesn't shift because we all know who wins and who loses and isn't even allowed to talk about their needs.

Actually Blueberry going back to your early post yesterday it's highly likely Miss B could find herself in this situation. Given that it's basically anything anyone says that another deems offensive, hostile etc. And given she is a female who wants to be able to openly debate there will be an individual just sat dying to be offended.

Exactly so.
I never ever thought I'd be fighting to keep my single sex spaces as single sex. It just never occurred to me pre 2004 that a scenario like this would or could happen.

And then of course along the way somehow children were drawn in and started mutilating themselves with surgery, legally even before 18 years of age. I mean ffs dystopian future that no one ever wrote about.

This is the police unlawfully interfering with our human rights. Is that okay with some people as long as it's only happening to people they don't like?

The police were compared to the Stasi, Cheka, Gestapo. Is that how you want to live? It might be funny to you whilst they're only targeting your ''opponents'' and acting like henchmen for MRA misogynists, but you won't be laughing when they eventually come for YOU for expressing legal, valid views.

I think it's the down side of the ease data collection and processing. People start collecting data and making files on all sorts of things just because they can. Unfortunately the validity of the data is not always questioned rigorously enough. Too often it's quantity over quality. If we're not careful all these sophisticated systems are reduced to being huge gossip machines.
