Sorry to ask a potentially stupid question here, but... so if the judge is saying that people should record their sex as it appears on their birth certificate, does that not mean that a trans woman could record their sex as female, even though they were born male as they would have their birth certificate changed once they legally transitioned?

So we still wouldn't have accurate figures?

Yes. But they did point out that the real numbers could be extrapolated as they know how many GRCs there are. They would be statistically accounted for.

Afaict, there are some legally arguments, but so far they are also arguing that 1) there should be some actual investigation into whether any incident took place and whether there was any hate there and 2) there is a chilling effect of the possibility of anything being 'recorded' if someone interprets it as hate (totally my interpretation)

Going back to the ONS implication that "we could reverse engineer a sex + "trans identity" response to work out sex" (my paraphrase) that doesn't work does it? If I put I'm female but I i.d. as having some trans identity, would they think I'm male?

Can they, though? I can see how they could (maybe) do this for the very top-line totals (e.g. "we have 30 million women, minus 5000 male-born people with a GRC"), but I would guess it's impossible to apply this at a more granular level, e.g. number of female Buddhists in Bognor Regis aged 65+.

Very difficult to reverse engineer Cardinal. A well known trans woman on twitter said she put female for sex and non binary for gender identity... so there's no way to count her as a trans woman
