As some of you know the DWP has removed 'sex' from its equality statement, I have received yet another reply telling me 'gender is more inclusive'

I have sent the following email - name redacted obviously but to [email protected] -this is my local team, the others are

I am rather puzzled by your reply. You state that 'gender' is to be 'as inclusive as possible'. Every single human being in the world has a sex (male, female or intersex) but not everyone has a gender. I do not have a gender and an increasing number of people are rejecting this social construct due to 'gender stereotypes' which are damaging for everyone.

So how does removing a term, identified in law, from your equality statement and substituting one that is offensive and damaging correspond with 'inclusivity'.

On a further note, the Equality Act is about being 'fair' not 'inclusive', this is for many reasons, eg some people are exempt from the act due to clashes between the rights of groups with 'protected characteristics' eg to learn to drive a car you must be at least 17 years old (or 16 in some circumstances), you must also be able to see.

You are still discriminating against me because I have a sex.

I couldn’t give a toss whether they think gender is ‘more inclusive’! sex is the protected characteristic under the equality act and sex is the data they should be collecting as a public body. Organisations can’t just decide which bits of laws they’ll comply with & which bits they won’t!

They closed my case, I went to the Sec of state who sent it back to the DWP

And being a public body they have a 'duty' to:

Eliminate unlawful discrimination, harassment and victimisation and other conduct prohibited by the Act.
Advance equality of opportunity between people who share a protected characteristic and those who do not.
Foster good relations between people who share a protected characteristic and those who do not.

Emailed today, inviting them to explain why they think they can unilaterally decide to change a characteristic protected by law to a social construct which has no legal definition. Can't wait for the reply.

Previous correspondance with them says, this is bloody pointless. Until they have an issue, where they are actually taken to court for failing to record sex, I cannot see any changes. Surely they can see how this is problematic though, especially when the law requires them to have data on sex (as far as I am aware?!)

Might be worth telling Liz Truss and Baroness Nicholson? DWP might take marginally more notice of them.

The equality statement refers to sex and gender identity. The PSED focuses on the protected characteristics of sex

Forgive my pedantry but being 'intersex' isn't a sex. People with disorders of sexual development are still male or female it's just that (very rarely) it may be hard to tell or possibly require surgery to correct congenital abnormalities in genitailia.

I googled and got FOI request 4129, 'Equality Act related information and guidance' which replaces sex with gender, but can't seem to attach it. That is laughable!

I think I’ll find it hard to write though as the mainstream text (linked by NeverTrust) is ok.

I sent an email of complaint echoing yours to my local team, @sashh. It's important to let them know that they are being closely watched and monitored, and that they aren't going to get away with little sleights of hand like this.

You've spurred me on and I have email my local team, basically referencing the link @nothingcomestonothing kindly posted and asking them to explain themselves.

I also said I was "aware of" your letter and again asked them to explain why gender is being used instead of sex, and why the have missed off pregnancy and maternity in their list of protected characteristic.
