Gardeners - the previous thread was deleted because I linked a tweet from Safe Schools Alliance.

There is a hearing on 12th Jan to try & secure a judicial review of the CPS’s membership of Stonewall’s champions programme. Please support the crowd justice fundraising.

Please google SSA/crowd justice. You know what to do.

However we are disappointed that the CPS chose not to inform the claimant of the permanent withdrawal of the Hate Crime Schools Guidance prior to today. This has wasted a lot of everyone’s time.

Seems like a deliberate move on their part?

Indeed - but would it undermine the CPS’s claim for damages - as this is the bit the judges ruled on - which the claimant didn’t know about until turning up to court?

Also - will there be another dig for the claimant’s damages - not that I think they are due - but will I definitely dig for England for this inspirational girl if needed. She is extraordinary! Flowers

Just to be clear, the defendant (The CPS) did not succeed in the claim. The salient point is they attempted to, which was frankly, intimidatory. And yes, the revelation of permanent withdrawal of the CPS guidance came during the hearing, a tactical bomb drop. Draw your own conclusions about the motives of a government body that plays games like that.

The other important thing take away from this is that the guidance has been withdrawn from schools and will not be back. This is a massive win and sends an important message. And although deeply frustrating they waited interesting the hearing to disclose this is an important win.

Two guidance documents have been withdrawn following legal action. Another teenager is challenging the College of Policing aver their hate crime guidance. I think there is so much to take from this

highame she's not been put off, but 15 is a hard age to learn that powerful people don't always act with scrupulous integrity. She's focusing on trying to get through GCSEs in a pandemic and last night was mostly ranting about businesses scamming hungry kids with half a red pepper and chunk of carrot and pretending it £15 worth of food, so her determination to make the world better remains.

Is it Miss B?

Miss B. is 14 years old. She is the middle child of a happy family. She has an auditory processing disorder, dyslexia, and wears a hearing-aid. She enjoys meaningful discussions about important issues, and considers herself “gender-critical”. She believes that sex is distinct from gender identity, and that it is immutable.

Miss B. intends to challenge the APPHCG on the grounds that the recording of “non-hate crime incidents” breaches date protection law; violates the fundamental right to freedom of expression; and that in adopting the APPHCG, the College of Policing breached the Public Sector Equality Duty.

While it may be necessary for police to gather intelligence on people who pose a genuine risk to society, the APPGCG’s guidance would lead to malicious reports wasting police time at best, and children’s futures at worst. The consequences of this challenge go beyond the walls of the classroom. School pupils who learn to self-censor become citizens who will do the same. In a democracy, everyone should be free to speak without fear of being punished – especially children, who are at the earliest stages of forming their opinions.

Update on Help support a teenage girl challenge CPS LGBT+ hate crime guidance

Apologies for the delay in updating you on this case. We were waiting to see if the claimant was going to appeal the decision. On the advice of her legal team, she has decided not to appeal so we will be closing this Crowdfunder after we have updated all our backers.

On the 12th January we were very pleased to learn that the Crown Prosecution Service (CPS) had permanently withdrawn its LGBT+ Bullying and Hate Crime Guidance for Schools. We had very seriousconcerns about the impact of this hate crime guidanceon girls’ ability to stand up for their rights in schools. We are delighted that it will not be re-issued.

At a hearing in January a judge considered the application for ajudicial review of the participation of the Crown Prosecution Service in Stonewall’s ‘Diversity Champions’ programme. This application was based on the stated intention of the CPS to review and re-issue their LGBT+ Bullying and Hate Crime Guidance for Schools, which they had withdrawn after a teenage girl challenged it on the grounds of safety and freedom of speech. The teenager felt that they would not be able to review it fairly while Stonewall was embedded in the service.

The counsel for the defence announced during the hearing that the CPS’ Hate Crime Schools Guidance had now been permanently withdrawn and there were no plans to reissue. This is a relief for the teenage claimant. However we are disappointed that the CPS chose not to inform the claimant of the permanent withdrawal of the Hate Crime Schools Guidance prior to the hearing. This decision wasted a lot of everyone’s time.

The judge decided that the judicial review should not go ahead. It is disappointing that he seems to have accepted that beinga member of Stonewall’s ‘Diversity Champions’ scheme is merely a matter of employee rights. He has not acknowledged that in fact their influence goes much wider than this. After much consideration and on the advice of her legal team however, the claimant will not be launching an appeal.

We are very concerned by the lack of transparency in the relationship between the CPS and Stonewall, both regarding the development of the Hate Crime Schools Guidance and also in other matters of policy and guidance. Further, we are disgusted at the CPS’s attempt to depart from normal practice and seek damages against a 15 year old girl. We believe this is intended to have a silencing attempt on others seeking to oppose Stonewall’s anti-women and anti-safeguarding ideology.

Justice Cavanagh refused to award costs for today and we thank him for acknowledging that Stonewall’s ideology is at odds with the views of many women’s rights groups and lesbians.

We will continue to oppose any schools’ guidance that undermines the safeguarding and inclusion of ALL children and thank everybody who has supported both this teenage girl and our work on prioritising the safety of children.

We will continue to campaign for safeguarding and the correct interpretation of the Equality Act.

Thank you to everyone who contributed to this Crowdfunder, whilst the Judicial Review was not granted, the Hate Crimes pack has been permanently withdrawn.

The stonewall workplace equality index explicitly says that they assess companies (which pay for membership)...

"...by asking a series of questions about things you might have done. We split the questions across different sections – employee policy, the employee lifecycle, staff network groups, allies and role models, senior leadership, monitoring, procurement, and customers, service users and clients."

They want it embedded throughout the entire organisation and you're also meant to make the same demands on your suppliers. It sounds like a pyramid scheme!

This should be part of Allison Bailey's case. It will shine lots of sunlight on this part of the scheme and it's (the scheme's) ability to dictate HR policy in companies
