I decided to split this off into a separate thread so it is more visible and won't get lost within the pages of the one above.

For Women Scotland have published a template that you can use to email your MSPs. Please do so if you can.

Gender Representation on Public Boards (Scotland) Act 2018

The vast majority of responses to the Government's consultation on statutory guidelines for the GRPBA objected to the definition of "woman" (see the article in the Scotsman). Despite this, the Government quickly pressed ahead with publication of guidelines which enforce the Act, and which leave the definition unchanged.

We have sought legal opinion on pursuing a judicial review to challenge this Act, and initial advice looks promising. We'll keep you updated as we progress, but in the meantime it would be helpful if everyone could contact all 8 of their MSPs to express concern and ask them to take further action.

I am writing to you regarding the Gender Representation on Public Boards (Scotland) Act 2018. An analysis of responses to the public consultation, published on 3rd April, found that "much of the feedback focused on concerns raised regarding terminology and definitions used in the Act. More specifically, the term "gender" and the definition of "woman" for the purposes of the Act."

The Government failed to take these concerns into account and have since published the Statutory Guidance for the Act, with the definition unchanged.

The test for "living as a woman" in the guidance is offensive and seems to exclude many women, as well as include many men into the category of women. In no way does this contribute to the stated aim of the Act, ie. to improve the representation of women on the boards of Scottish public authorities.

As we already have an established definition of "woman" in the Equality Act as being "a female of any age", I would ask you to write to Christina McKelvie, Minister for Equalities to request the Government urgently reconsiders the Statutory Guidance.

Could you also ask Ms McKelvie on what grounds the Government disregarded the majority of responses to the consultation, and what legal advice the Government received regarding its authority to undermine key definitions in reserved legislation?

Not sure, OhHolyJesus. If the Scottish Government come back with something belligerent, and For Women Scotland find they have a strong case for a judicial review, then some 'digging' by the needed from near and afar.

I think for now those of us in Scotland have to get in touch with our MSPs and see what they come back with.

OhHoly I think outside Scotland it might be worth writing to MPs asking them to contact Liz Truss to find out if it is permissable for one part of the UK to undermine reserved legislation and what the potential impact might be. Also say that as Scotland are seemingly misrepresenting Equality Act, along with Gov depts and public bodies like CPS and EHRC, there seems to be an urgent need for guidance as highlighted in last year's report from women and equalities committee.

Yes, please email MPs and ask them to get in touch with Liz Truss about clarifying the undermining of reserved legislation.

Indeed, Gibbonsgibbonsgibbons... What was the point of the consultation, especially after it was all done and dusted... And then didn't bother to take into account the majority of the views expressed. They must think women in Scotland are so stupid.

Thank you for your email raising important issues and concerns about the Gender Representation on Public Boards Act 2018.

Both I and my Scottish Conservative colleagues (who are the largest opposition party) voted against the bill at stage 1 and the final stage 3 vote in the Scottish Parliament on 31st January 2018.

Specifically you ask why the Scottish Government disregarded the majority of responses to the consultation, and what legal advice the Government received regarding its authority to undermine key definitions in reserved legislation.

This bill is not the only example of the SNP government disregarding the public response to a consultation and simply carrying on with its own political agenda. Furthermore, although the Scottish Government repeatedly talks about "human rights" it does not necessarily have regard to them where it wishes to promote its own contrary political viewpoint in policy or legislation.

Apparently MSPs are getting lots of letters about this topic and it’s being noticed, so please, please message all 8 of your MSPs! And share with / ask others that you know who might be interested to do the same, so it can have the most impact.

It's worth bearing in mind that all political parties are starting to think about what their manifestos will say about GRA reform ahead of the Scottish elections. They need to get a sense of the complexity of this and not assume it's an easy vote winner as women will be demanding answers.
