Yes, thanks Charlie.

I bloody love this place. Although if it weren't for you vipers I'd not have been radicalised in the first place...

Does anyone know if a victim has been compelled to use female ptonouns in any other case? There have been quite a few rape and sexual assault cases involving trans women? I wonder what prosecution lawyers are telling victims to do in these cases and what happens if they refuse.

ThePurported · 24/12/2019 11:49

I've wondered what happens in rape cases, Sadly.
Either way, it's a horrible thought. A woman having to refer to her rapist as 'she' because that's HIS preference - or being given permission to use 'he' when it's rape but not when it's "just" an assault like in Maria's case.

CadburysTastesVileNow · 24/12/2019 12:50

Just tried to check the website but it is 'frozen', at least on my computer. Wondered if they were updating ...

I don't know why the post I quoted was deleted, which means mine was, but I'm assuming my only 'crime' was quoting the other post, so here's the link again to the article about Maria MacLachlan being forced in court to use 'she' to describe the person who assaulted her.

Maya posted a list of ongoing or upcoming legal cases around relevant issues:

And Astonlegalbrain has just joined MN for FWR:

In the discussion of Maria's case there was a link to the official court policy requiring witnesses to suspend their disbelief in deference to people's stated gender identity. The courts policy appears to follow Stonewall guidelines rather than the ones provided in the EA2010.
I hope I said that in a way that will not bring another strike.

FannyCann · 24/12/2019 19:21

Couldn't Maria avoid the use of pronouns and refer to the person by name continually?

Creepster · 24/12/2019 19:28

IIRC that is what she tried to do after the judge admonished her.
She was not the only witness who 'misgendered' the person who assaulted her.

It's very difficult to do this when you're on the stand. It's a lot of pressure. The court is supposed to be witness/victim friendly as well as dependent friendly if there's going to be justice.

Sexequality · 24/12/2019 22:24

It is lying under oath. As a witness you have to say what you saw not what the defendant wanted you to see.
