Rape accused boy deserves leniency because he's from good family

Just come across this story while reading the news...

Short version: boy rapes girl at party, sends video to his friends. Judge says he should be tried as Juvenile so it doesn't ruin his college chances and tells girl she's ruining his life. Appeal court decides he should be tried as an adult.

The judges comments to the girl are unbelievable.

Not once have I seen any consideration for the girl's life - except growing up in India when her life was deemed ruined and her only acceptable option was to go and commit suicide. Hmm Angry

According to the panel’s decision in that second case, Superior Court Judge Marcia Silva had denied a motion to try a 16-year-old boy, identified in court documents as E.R.M., as an adult on charges that he sexually assaulted a 12-year-old girl.

The victim alleged that E.R.M. penetrated her “with force” in 2017 despite her “repeatedly” saying no, biting him and asking him to stop. She began to bleed, prosecutors say, and eventually succeeded in pushing the boy off

In her decision to deny the waiver, Silva wrote that the girl’s assault claim, even if true,“is not an especially heinous or cruel offense beyond the elements of the crimes that the waiver statute intends to target.”

″[B]eyond losing her virginity, the State did not claim that the victim suffered any further injuries, either physical, mental or emotional,” Silva wrote

And yet I've seen people on here call for trial by jury to be done away with in the case of rape and instead have it decided by a judge. If this is the outcome? Do these judges ever have to justify their comments? What are they thinking?

I'm still angry about it this morning (although relieved the Judge was overruled). Doesn't the fact the girl has had her life turned upside down matter? But that isn't as important as a boy hurting his college prospects. He's the only one that ruined those.

It took me years to fully accept my attack was in no way my fault. And I was a lucky one where it was a failed attack as I was able to fight off and run before anything happened.

I don’t actually think this is a real judge.

It should really be the other way round though.

A child with no opportunities, from a broken home without a glittering future to think about. I could argue that child needs leniency because as a society we let them down and failed to demonstrate good citizenship to them. No wonder they can’t practice it.

But a smart kid with the all the benefits of a good education, a supportive family and social circle, with excellent prospects. That kid should know better.

Not from the op but lass quoted it and others are commenting. From the name I'm assuming it's a woman so both male and female judges appear to have the same view.

Agreed - ‘good’ family I guess means food on the table, both parents around, good education, nice home... even less reason to act like a kid (actually a young man) who doesn’t know right from wrong.

If one of his 'womenfolk' had been raped I think the judge would feel differently about the offence, he would be angry because his 'property' had been violated
in this case that girl was someone else's property and she didn't matter, he identified with the perpetrator and can't bear to think of a young man's life being ruined over a 'worthless' woman

That poor, poor girl. Shit like this enrages me. Not only because of the multitude of reasons so many pp have pointed out. Because every goddamned point is completely valid. But as a mother of boys, it is this excusing, minimising, and justification of abhorrent behaviour that makes it feel like a losing battle for those of us trying to teach our boys to be better, to respect girls/women, and more importantly that actions have consequences and if you want to call yourself a man you need to man up and accept them. Not rely on your parents wealth, reputation or highly paid counsel.

I would also argue that he should be treated more harshly if he came from a 'good' family, he cannot use a dysfunctional background as mitigation.

This is an appalling miscarriage of justice
