Just come across this story while reading the news...

www.bbc.com/news/world-us-canada-48858761

Short version: boy rapes girl at party, sends video to his friends. Judge says he should be tried as Juvenile so it doesn't ruin his college chances and tells girl she's ruining his life. Appeal court decides he should be tried as an adult.

The judges comments to the girl are unbelievable.

A bit more detail about Family Court Judge Marcia Silva.

And yet I've seen people on here call for trial by jury to be done away with in the case of rape and instead have it decided by a judge.

No, you have seen people discuss whether juries should be replaced by a trained tribunal.

''If we did get rid of juries, we would need more than a judge who has undergone specialist training. Perhaps one option would be to appoint a panel of assessors, such as those that sit on discrimination cases, all of whom would have expertise in issues relating to sexual violence. Panellists could help inform the judge in the case about relevant issues, and remind them of some of the facts as well as the myths; for example, people of all ages, from babies to elderly women are raped (sexual attraction has nothing to do with it); not shouting “no” does not mean consent; and the idea that alcohol is the new short skirt – that a drunk woman is signalling she’s “up for it”.

That was a suggestion. Another suggestion was to use only judges.

Another suggestion was to use only judges.

Which is always overwhelmingly discarded as even more problematic than juries.

DarkAtEndOfTunnel · 04/07/2019 17:39

I keep having to say this. There is no such thing as law and justice for women. Britain is just as bad now. Essentially the entire establishment of western society now exists purely to protect the nebulous ideas of pre-existing "social status". We've seen it in Britain before: it was called "Old Corruption".

I hope this girl has someone to support her. Not only the rape, but having it filmed and passed around, and then that scum of a judge maintaining male rights to social status over women and girl's health and lives. Not only should the rapist be chucked in jail - so should this judge, for his appalling miscarriage of justice.

I really fail to see how a man - well anyone - could not imagine how this girl feels. How her life had been changed by this. All he is worried about is how this will affect the mans life? Boo flipping hoo.

origamiunicorn · 04/07/2019 17:54

I think we need to ruin boys lives to set an example. All this is doing is breeding entitled pricks like him.

Good home my arse. Who cares, boo fucking hoo.

This whole juvenile thing is out dated and fucking ridiculous actually. I don't care if you're 10, you commit a crime, you get the same sentence as an adult would. All this fucking pandering to these animals makes my blood boil and we are setting up a real problem for the future.

I could go on but I'm too angry to type a coherent sentence.Angry

Gingerkittykat · 04/07/2019 17:55

The article above said the boy and 12 year old had been boyfriend and girlfriend for a year. Something has obviously went wrong there too, firstly for a teenage boy to be attracted to an 11/12 year old and also for those around them allowing that to continue.

Whosorrynow · 04/07/2019 18:06

if he was from a poor family they'd go hard on him but because his family have money they go easy
we are 'instinctively' sympathetic to those who are like us and who come from backgrounds like ours, a male judge is from a wealthy/privileged background and here he is just going with his knee jerk reaction
of course the reason we have a judicial system is to mitigate the tendency of humans to be biased like this, judges should be fair and impartial, they should not self indulgently promote the interests of the rich and powerful

IntoValhalla · 04/07/2019 18:07

Oh yeah....he’s clearly from a great family. Hmm

If my DS grows up to think that raping someone is ok, then I’ve failed spectacularly as a parent.
“Good family” my arse Hmm

LordProfFekkoThePenguinPhD · 04/07/2019 18:10

Well the family may be good but he certainly has no moral compass. Unless by ‘good’ the ‘good’ judge just meant monied and well connected?

IntoValhalla · 04/07/2019 18:17

LordProf All about the money.

For some weird reason, I’m too many people’s weird little minds, money automatically means decent people, with a well calibrated moral compass Confused
