I found this part particularly interesting:

As well as the standard employment law charges such as discrimination and victimisation, the case also rests on an argument that has never before been tested.

O'Donnell and her lawyer — Robin White of Old Square Chambers — allege that it wasn't just what happened in the newsroom but also what those inside it published in the newspaper about trans people that constituted a hostile, transphobic place to work.

Should O’Donnell be successful, therefore, it would mean a newsroom’s output could be deemed an internal, employment issue too. News outlets may in future have to consider how their coverage of trans people and other minority groups could be in breach of employment laws that protect members of these communities on their own staff from discrimination and bullying.

From reading the article it seems that this is quite a significant part of their case and it seems that this could be quite interesting to watch.

On the one hand it can be argued that this individual was subject to horrible bullying and her pleas for her employer to stop inciting public transphobia were ignored.

On the other it could be seen as a tale of an employer who simply could not cope with the demands of their employee who were demanding that didn't consider science in their discussion of a current issue.

No I disagree. The Times chap is making the point that they do thousands of stories, none Is over important and there is no huge agenda on trans issues. He’s effectively saying it’s beneath his attention.

But the current trans movement is doctrinaire, uncompromising. Led by mainly older trans-women — ie born men — it won’t acknowledge women’s rights or feelings. It fights for two principles. First, “self-definition”: a person is the gender they “feel” inside, so a trans-woman “is” a woman even without physical change or while retaining male genitalia. Second, “affirmation”: everyone must acknowledge this inner gender identity. Hence the right to waltz into women’s private spaces is sacrosanct.

For months, researching the rise in referrals to gender clinics of teenage girls, I’ve been shocked at how the trans lobby, abetted by a cowed LGBT movement and deluded politicians, are prepared to sacrifice the wellbeing of children to attain those two goals.

This week the Scottish government published its transgender guidance for schools, drawn up solely by activist groups such as Mermaids. If Justine Greening implements a highly contentious women and equalities committee report, such rules will apply everywhere. On changing rooms it states: “If a learner feels uncomfortable sharing facilities with a transgender young person, they can be allowed to use a private facility . . . or to get changed after the trans young person is done.” So if a girl objects to showering with a male-bodied pupil, she must go elsewhere or wait outside. For overnight trips: “If a transgender young person is sharing a room with their peers, there is no reason for parents of the other young people to be informed.” So you have no business knowing if your daughter is sleeping alongside someone born a boy.

It recommends schools allow a child to change gender without parental consent. Moreover, if parents are not wholly behind a child’s decision: “It may be useful to approach the local authority for additional guidance”, ie report them to social services, perhaps to question custody. (continues)

Some people expressed concern after it emerged that the service is provided on the basis of what sex someone self-identifies as, rather than their biological birth gender.

He seems quite out of his depth actually but can you imagine if the editor of the Daily Mail were being asked these kinds of questions about the paper's coverage of BME people and women?!

I can't imagine The Times losing this case because the implications for freedom of the press would be too huge, surely.

Because the press can't be prevented from sharing facts that upset and offend a political lobby group. Particularly facts about the suppression and oppression and removal of rights/changing and breaking of laws that protect women and children.

It seems to me the equivalent is any woman employed by The Tines who doesn't get promoted can claim inherent cultural misogyny on the basis they publish Rod Liddle.
