School says it followed procedure, but I simply can not understand why he wasn't excluded.

Because boys are considered more important than girls?

Because I literally cannot think of any other reason.

SeamusFinnigan · 20/02/2019 13:38

Yep, I think Plum has got it in one!

I'm sickened by this. That poor girl!

Popchyk · 20/02/2019 13:45

assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/719902/Sexual_violence_and_sexual_harassment_between_children_in_schools_and_colleges.pdf

"Where a criminal investigation into sexual assault leads to a conviction or caution, the school or college should, if it has not already, consider any suitable sanctions in light of their behaviour policy, including consideration of permanent exclusion.30

Where the perpetrator is going to remain at the school or college, the principle would be to continue keeping the victim and perpetrator in separate classes and continue to consider the most appropriate way to manage potential contact on school and college premises and transport. The nature of the conviction or caution and wishes of the victim will be especially important in determining how to proceed in such cases".

The Guidelines for dealing with it are very much "schools must decide what to do on a case by case basis".

The Guidelines provide no actual guidelines for assisting in this decision.

Which means that schools do fuck all.

Badgerthebodger · 20/02/2019 13:45

Absolutely appalling that poor girl. How is that even supposed to work with a restraining order? Just beggars belief, once again we are told how little girls matter in the eyes of the powers that be. I mean he was convicted ffs how much more evidence do they need?

GerryblewuptheER · 20/02/2019 13:46

Poor girl Sad

GregoryPeckingDuck · 20/02/2019 13:50

Insane. Surely they should be setting up special schools with specially trained staff for child criminals.

I think there should be more girls schools. But given boys do better in mixed schools and the heavy usage of girls to act as buffers between disruptive boys it wont happen.

Not unless you pass the 11 plus or pay for private school.

And yes I know girls can be just as mean and all that stuff however given it's well known that girls do better in single sex schools and boys do better in mixed well we all know what they picked to be the majority set up and why

This is the price girls pay

Popchyk · 20/02/2019 13:56

Can you imagine this in an adult place of work?

Imagine that you work in an office where a man is convicted of sexual assaults on a woman who also works there. The sexual assaults happened on the premises.

After the criminal conviction and with the man now on the sex offenders register and with a restraining order that prohibits him from coming into contact with the victim, the man gets to come back to work. Alongside the victim. The company take no disciplinary action against him.

Why are young girls deemed worthy of less protection than grown women?

GerryblewuptheER · 20/02/2019 13:59

pop

Dont think jts that uncommon.

Look at that girl who was forced to go back to work along side the man who choked her out

RiverTam · 20/02/2019 14:03

it's the cult of inclusion again, isn't it?

RhymingRabbit · 20/02/2019 14:05

Can you imagine this in an adult place of work?

I find myself saying this a lot in general about schools tbh - bullying, sexual harassment, sanctions etc. The more people rely on schools for childcare, the more power we are willing to give them, the more terrifying they become. But I digress...

This is just awful. I agree that this is simply another example of boys and men being more important than girls/women. I wonder if any child has been excluded from this school and what they were excluded for?

There is a vocal group of teachers and educationalists who are against all school exclusions, citing an alleged "PRU to prison" pipeline. The definition of Special Educational Needs has been extended to include any kind of behavioural "problems", without reference to what might be causing them. Their attitude is that any individual with criminal behaviour is thus by definition "SEN" and that exclusion is therefore discriminatory, and that school is the right environment for them to be "helped".

Never mind that schools usually do not have the resources to provide this help, nor to provide adequate protection for past and potential future victims. So while sexist attitudes may well be involved, that is unlikely to be the only reason .

ZuttZeVootEeeVro · 20/02/2019 14:08

I'd have thought that bring on the sex offenders register would exclude someone from being near any school.

I'm sure there must be places where he could receive an education, but not be in a school with girls, especially his victim.

GrinitchSpinach · 20/02/2019 17:41

Disgusting.

The victim told the BBC the guilty verdict helped her to deal with the ordeal.
"It took a massive weight off my shoulders to be listened to," she said.
"For most part I felt I was going mad. [I was] told in court I was a liar, but to be believed was a relief."
But she said it had been incredibly hard to stay at school, knowing her convicted attacker had been allowed to continue there too.
"I thought I wasn't going to see him. They said I'm their main priority. "

I am glad she has found some relief in being believed, but FURIOUS her feelings and opportunities have not been prioritized as promised.

The policy is that schools should not offload their problem kids but should take responsibility for reforming them.

Well-meaning, but with unintended consequences.

Dermymc · 20/02/2019 17:45

This isn't the first time and it won't be the last. I have worked somewhere this happened.

It was a difficult situation for the school as the incident didn't happen there. A lot of schools policies are around incidents on the premises. This made it difficult to exclude the attacker as there was no "reason" to. The parents of the attacker were quite switched on re their "rights" therefore school was pretty much stuck.

Dermymc · 20/02/2019 17:48

This ^^

The law of unintended consequences.

There are some people who cannot be rehabilitated, especially not by teachers.

MillytantForceit · 20/02/2019 17:50

And the offloading was a consequence of league tables.

'I know a woman who swallowed a fly....'

olderthanyouthink · 20/02/2019 17:58

Poor girl Sad I wonder what it's like for the rest of the girls, we were forced to sit boy-girl-boy-girl and I wouldn't be happy being made to sit with him

Anyone want to add mixed sex facilities in to that mess

feministfairy · 20/02/2019 18:31

This is headlining the local news today which is excellent.
It is unthinkable that a girl's safety matters so little to the school and the Local Authority. Shame on them.

NothingOnTellyAgain · 20/02/2019 19:47

and all the other girls too

i was horrified but not at all suprrised

recent article where with younger childen the girl had to stay in the same class as the boy who raped her

it is VERY important to lots of poeple that women and girls know their place

BreakWindandFire · 20/02/2019 20:02

Awful. Why the hell have the victim's parents not pulled her from the school? Yes I know it's bloody unfair, but I bet neither of them would spend all day in work with their sex attacker.

NothingOnTellyAgain · 20/02/2019 21:22

I can think of quite a few reasons tbh

He should lose his school friends familiarity teachers not her

That is punishing her Doubly

There may not be another school / decent school in striking distance

Sounds of it they must be doing a levels she would lose all that I think with upheaval of change and aren't some things continuous assessment

If walk leave back down they win
And moving school in middle of important bit could have life long repurcussions

feministfairy · 20/02/2019 21:27

I wonder whether this is connected to the changes in use of bail and the police not using it as they used to? I have worked with lots of cases where a boy has been charged with sexual assault / rape and as part of his bail conditions, he was not able to go near witnesses. Therefore he had to move schools / receive education elsewhere and the girl was protected and able to continue in school.

MaryContrary1995 · 20/02/2019 21:28

I wonder if there's a petition somewhere on this?
