Represented by Claire McCann.

If successful this could also apply to sexual offences such as rapes.

Implications of this plus self-ID for women's safety are hugely disturbing.

Who would have thought it

Floisme · 09/09/2018 08:56

Did anyone hear Claire McCann speak at the WEP conference last night?

MrsBertBibby · 09/09/2018 08:57

Offences that old would only be showing up on a pretty enhanced DBS check, surely?

CuppaTeaAndAJammieDodger · 09/09/2018 09:03

I came on to say "surely this can't happen" - but nothing would surprise me these days.

So this would render laws such as Sarah's and Claire's law completely useless.

FFS

groundcontroltomontydon · 09/09/2018 09:04

Where is the case law to support such an application? Where??

ItsAllGoingToBeFine · 09/09/2018 09:08

I don't think there is any? The article says "right to removal, if established"...

I'm guessing this may be strategic litigation.

Milliepede · 09/09/2018 09:18

Christ on a bike. Can you imagine the perverts of this world rubbing their hands in glee at the thought of them being able to hide their crimes if they identify as xyz? I have to have an enhanced DBS evry time I apply for a new job in my field. I never bleat on about my privacy being compromised when these checks are done on me, I accept it as being necessary to protect the vulnerable people who I work with. NO NO NO.

olderthanyouthink · 09/09/2018 09:21

No read it yet but does that mean that a sex offender could pass a CRB check? And then go work with children or vulnerable women?

ItsAllGoingToBeFine · 09/09/2018 09:23

No read it yet but does that mean that a sex offender could pass a CRB check? And then go work with children or vulnerable women?

Precisely this.

olderthanyouthink · 09/09/2018 09:24

How does a DBS work with a trans person anyway if "Trans people with a gender recognition certificate are legally entitled to keep their birth gender secret."? Jane smith gives her details over but doesn't say anything about being born John and a convicted sex offender as John?

Beachcomber · 09/09/2018 09:29

If this case is won it will set a dangerous precedent.

And I am increasingly convinced that it is not simply an unhappy coincidence that much of what the trans juggernaut wants is a gift to sexual predators and creepy men.

Wanderabout · 09/09/2018 09:31

older there is a thread on that somewhere. The trans person can omit previous history on the form but must make contact via a sensitive applications route separately.

The new wording on the DBS form is very unclear though and suggests you can just omit the info.

TerfsUp · 09/09/2018 09:31

Good grief. This, coupled with the proposal for self-ID, would result a field day for sex offenders.

TerfsUp · 09/09/2018 09:31

The trans person can omit previous history on the form but must make contact via a sensitive applications route separately.

Doesn't that rely on the person being honest and trust-worthy, though?

Datun · 09/09/2018 09:42

I'm guessing this may be strategic litigation.

This, this, this.

Importuning as a man? Fifty years ago? And he's had a clean record since?

Give the guy a break. What's it to you? Everyone thinks he a woman. This male crime is a constant disadvantage. Erase, erase.

Precedent set.

olderthanyouthink · 09/09/2018 09:43

Thanks Wanderabout

TerfsUp I was just reading a DBS page for trans people and seems like it requires honesty but the DBS could find out anyway

Stickerladiesoftheworldunite · 09/09/2018 09:53

Stop putting trans feelz ahead of safeguarding!

boatyardblues · 09/09/2018 09:56

Yes, it's interesting that the case is ostensibly a sympathetic case, when establishing a precedent would give all the wrong uns a free pass at scrubbing their dodgy history clean.

Beachcomber · 09/09/2018 10:14

Yup. It must be strategic.

They know it would be too hard even for the trans juggernaut to set a precedent with a case of more recent offending especially if it was sexual offending against children or women.

But those are the cases that they want to set a precedent for.

This is grooming on a grand scale.

Beachcomber · 09/09/2018 10:16

And I wonder what organizations like the NSPCC think of this development.

Too bad they don't seem interested in questions about how the T affects safeguarding.

CAAKE · 09/09/2018 10:18

I bet they're fuming that the Challenor and Karen White stuff has all come out so close to this case. It's hopefully going to make pushing this nonsense through the courts somewhat harder.

Beachcomber · 09/09/2018 10:30

I hope so CAAKE.

However there does seem to be an awful lot of head in sand when it comes to joining up the trans dots.

OldCrone · 09/09/2018 10:33

Helen’s barrister, Claire McCann, said disclosure of offences that revealed Helen’s birth gender in criminal record checks was “severe and discriminatory interference with Helen’s right to respect for her private life”.

Is Claire unaware of the sensitive application route for DBS checks? A barrister would know about this, surely? The laws are already in place to ensure that trans people are not 'outed'.

Ereshkigal · 09/09/2018 10:37

No. As I said on the other thread the ramifications are horrifying. But Datun has it exactly right.
