Saw this news case today, and am not sure what I think:

I feel that it gives the message that it's ok for men not to worry about the age of girls/women they have sex with if they have reasonable grounds to believe they're 16+.

12 y/o cannot give meaningful consent to sex. They are children.

"she looked 16"
"she was out at 4am"
"she was pissed"
"she looked 20"
"why was she out in the middle of the night"

I am glad he admitted rape, because he raped her! He raped a child. No sympathy for him whatso ever.

All of that is victim blaming bollox. Crap that is frequently used to justify raping women/girls, and blame them for it. I met my dh when I was 15, he was older. Guess what? He found how old I was before refusing to have sex with me until I was 16. It wasn't that hard at all.

But he didn't think she was 12. Neither did anyone else.

Well we certainly dont want to be in a place where ID checks take place before sex with children do we? Cause sex with children is bad.

But if the solution to the outrage over this utterly unique case is to certify the sexual activity of women above age of consent via police checks and id cards then go straight ahead. Again though, its a method of regulating the sexuality of women and I am not a fan of that to be honest. May as well take trust out of the entire activity altogether and have cold, impersonal contracts drawn up prior to any sexual engagement.

You can be sure his barrister would have been asking for her sexual history in order to use it against her. These days he'd have to have a good reason for it to be admitted though.

Further, given that this is a 12 year old child, if she isn't "clean" fuck me then that means she has been raped before.

Is that just for 12 year olds, or do you extend that to anyone who's been raped?

This, unfortunately, isn't an utterly unique case, scottishdiem. Far too many cases happen where men claim they didn't know a child was under the age of consent.

Alternatively men could keep their dick in their pants when picking up young girls at 4 am.

Then start a campaign to change the age that children can consent to sex. What do you suggest? 10? 8?

The only reason i have sympathy for him is because I don't believe he is a predator and an abuser,so I don't view him the same as the ones that are.
But even in my sympathy and "devils advocate" position,I can't believe some of the responses on this thread,or that the sexual history of a 12 yo is even considered.

I doubt his life is ruined. The other thread is massively on his side, to the point where one poster suggested she raped him and two others have claimed he was coerced. Because she lied.

This isn't a one off case, a few years ago a judge agreed that an 11 year old looked older and was wearing teenage clothes, so gave a lenient sentence.

In 2012 two rapists jailed for 40 months each because a judge said their 11-year-old victim was 'willing', and 'looked 14' despite the fact it was videod and the film passed around, and the fact he agreed she had been exploited.

Everyone has a duty to check the person they are about to fuck is not a child. This duty includes men.

This is not an 'utterly unique case', scottish. Sadly lots of men rape children.

Also on the other thread, somebody is suggesting that the law is reviewed, as clearly girls less than 13 can look older, thus it is reasonable to use that as a defence for younger children.

For having sex with younger children, that should be.
