'I wish I'd answered the questions differently now I've seen the outcome' isn't really grounds for going through it all again though is it. And that reward for evidence to assist with his acquittal might just have well have said 'has anyone got any dirt on [victim]', what an absolutely vile way to behave.

How could he have adequately assessed her level of intoxication?

He was being cross examined this afternoon, I think the last thing I read was that bit about her being different in the room than on cctv. He'd been asked about sneaking out the fire escape and the fact that he went into the room and had sex with her and at no point knew her name.

I had wondered, given the grounds for the retrial seem to be a big secret, whether it was something to do with with an alleged lack of capacity to understand the previous process and proceedings.

This is it for me - how could he, how could anyone, possibly have 'reasonable belief' in her consent given the timescales and circumstances that he described.

And yes, the whole enjoying herself/changing positions herself/saying fuck me harder, just doesn't tally with CM describing her as 'sick' to the receptionist.

What really annoys me is he doesn't get resentenced if found guilty. It seems so unfair to put the victim through all this again and I wish that could be taken into account in sentencing

It really doesn't. He wasn't in that room very long at all. If someone goes from sober enough to consent, up for sex, changing positions, enjoying themselves to "sick enough to inform reception she needs watching" in such a short space of time then they are worryingly sick. That's not just drunk sick. That's something wrong sick. That's the kind of sick you think "oh shit, should I call for a doctor" .

Well the first jury didn't believe he could have, they convicted him based upon his own testimony didn't they? And no one else was there, no one else now knows anything they didn't know then. But someone remembered something relevant when £50k was on offer? Course they did.

Charlie if they've fabricated something, there's always a 'perverting the course of justice' charge, that they can call their vey own. It always gets you an immediate custodial sentence.

I think when CM described her as 'sick' he meant she was really drunk and possibly looked like she might vomit. I think he probably thought he was being a right gent 'looking out' for her like that. Fucking fucker.
