Paternity tests in France banned (more or less)

Annie11111 · 06/08/2014 12:36

'' Any paternity testing without a court order is banned, due to the official desire to "preserve the peace" within French families, with the French government citing psychologists who state that fatherhood is determined by coexistence rather than biology. French men often circumvent these laws by sending samples of DNA to foreign laboratories, but risk prosecution if caught. The maximum penalty for carrying out secret paternity testing is one year in prison and a €15,000 fine ''

What's your opinion on this? I think it's very disturbing and can't comprehend how it can happen in a 2014 EU country . I also don't see how it's a feminist issue like many are implying.

Ooh phone interview what was that how did it go?

CaptChaos · 06/08/2014 18:03

For a job oop nerth. Same as I did down south. It's only for a year.

I shall keep repeating that to myself, like a talisman!

SevenZarkSeven · 06/08/2014 19:16

Oh wow how exciting! Good luck with that, when will you find out?

TheSameBoat · 06/08/2014 19:51

Is it just me or does the possibility of such a high level of paternity fraud not constitute an excellent argument in favour of children automatically taking their mother's surname?

As maternity is the one thing you can be sure of.

ABlandAndDeadlyCourtesy · 06/08/2014 20:05

"find it odd that a women would talk about other women as a despicable human being on a feminist board."

Yy to this.

CaptChaos · 06/08/2014 20:27

I should find Wednesday or Thursday next week. Will be nice to be gainfully employed!

SevenZarkSeven · 06/08/2014 20:50

Really good luck with that chaos :)

SevenZarkSeven · 06/08/2014 20:50

I am old enough to remember a time, decades ago, when feminism hailed paternity testing as a magnificent thing because it empowered women to bring men to account. But nowadays that attitude has fundamentally changed even thorough, on balance, it still empowers women more than it disempowers them. Its sad to see the strange and uncomfortable bedfellows paternity testing and feminism have become.

ABlandAndDeadlyCourtesy · 07/08/2014 00:39

Fingers crossed, Capt.

Annie11111 · 07/08/2014 12:18

DWS, exactly. Men can now be held accountable. If this is a feminist issue then it's a positive thing for feminism.

As for me calling women despicable , I obviously meant (and made it clear twice) those who would not only cheat but trick a man into raising a child that wasn't his. Men and women can be despicable, it's not a ''quality'' reserved for just one of the genders.

Annie, it's perfectly possible that a few women know there's a doubt but don't know themselves the paternity - after all, if said women weren't having sex with their DPs in the month in question, it'd be pretty bloody obvious to the DP anyway, right?

Annie11111 · 07/08/2014 13:08

Yeah obviously. But she's still a lying , deceiving, awful human being. Actually that reminds me of a a guy I knew through a friend who worked as a contractor in Iraq and he was there for many months at a time, he was some sort of engineer, I'm guessing oil related . Anyway the money was unreal. But one day he flies back home (I think he lived in or around Seattle but not sure) and finds his wife pregnant when there was no way it could have been his. So they get divorced and he's forced to pay child support and alimony since she was a housewife (several thousands of $ a month, they also had 2 other kids together) . And to add insult to injury the new bf (unemployed, mind you) that got his wife preggo moves into the huge house he paid for while he has to gtfo and relocate to a shitty little apt because his Iraq job was over and the money was much worse. So basically he was supporting all of them , including the bf. Needless to say, he was quite suicidal. I hope he's doing better now Sad

covertly testing can lead to many errors and upsets. I'm thinking of babies sharing dummies for example. and there is the possibility of deceit by whoever is testing without proper supervision (could 'test' any child on the playground and then say 'see, she/he's not mine, so I'm not paying maintainance anymore).

btw the situation is the same in germany. ( don't know about fines, though).

ABlandAndDeadlyCourtesy · 07/08/2014 13:27

Annie, was the child support for the two children who were biologically his? I assume so as I doubt the US forces child support payments otherwise.

Are men who don't support their biological children also awful human beings, BTW?

CaptChaos · 07/08/2014 13:32

Thanks ABland. Here's hoping!

Annie11111 · 07/08/2014 13:57

Yes, you can even go to jail if you don't support a cuckold child.

And yes, men who abandon their children are the scum of the earth. Thankfully we have DNA testing now and men can be held responsible. Although many feminists hate them for some reason? Does not make sense. Maybe because there's a lot more everyday women using their partners' resources to fund a cuckold child than there are Jude Law's busting a nut inside some model?

What does this sentence even mean?

DisgruntledAardvark · 07/08/2014 14:04

"Cuckold child"? Hmm

ApocalypseThen · 07/08/2014 14:08

There's a popular belief - I'm sure you're familiar with It -that women are incorrigable liars. That's one of the reasons that rape trials are so difficult for women. That's why women don't really care for practices which feed into this perception. It is quite easy when you're not trolling

A 2008 study in the United Kingdom found that fathers were wrongly identified in 0.2% (1 in 500) of the cases processed by the Child Support Agency. Of that 0.2%, those resolved with DNA testing between 2004 and 2008 showed that between 10 and 19% of mothers had deliberately named the wrong father; none of the women were prosecuted.[3]

edition.cnn.com/2009/CRIME/07/15/georgia.child.support/

For 13 years, Hatley made payments to the state until learning, in 2000, that the boy might not be his biological son. A DNA test that year confirmed that there was no chance he was the father, according to court documents.

Hatley returned to court and was relieved of any future child support reimbursement but was ordered to pay more than $16,000 that he had owed the state before the ruling.

Latesha Bradley, an attorney who represented Hatley in that hearing, told CNN the argument for keeping Hatley liable for the back payments was that he had signed a consent agreement with the office of child support services. The court agreed that Hatley had to comply with the consent agreement for the period that he believed the boy was his son.
