DLA WAITING TIMES THREAD 64

zoeybrooks45 · 07/02/2025 07:06

Please feel free to add your scan date and whether it's a new claim/mandatory reconsideration/change of circumstances or renewal.
New claims (NC) - people are being told the wait time has increased to 25 weeks! I would say most are done before this though around the 20 week mark?
Mandatory reconsideration (MC) and Change of circumstances (COC) is around 20-25 weeks.
Renewals tend to be between 15-20 weeks.
If you disagree with the outcome of an MR you can appeal and go to court (tribunal)
Scan date is the date DLA scan your application forms on to their system, if you downloaded your application forms then this will be from when your award will be backdated from. If you called up for forms then the date on those is the date yours will be backdated from.
If successful and claiming universal credit (UC) please update them as this will entitle you to disabled child element adding extra to your award.

@UmElise Alot of the markers ( describers) for smi and vuw are almost identical but smi is more specific it's also more hard to prove on paper it's why the VUW criteria exists because dla don't do medical assessments on children which is a great thing, so if arrested development of the brain or a severe mental impairment can't be proved on paper then a child refusing to walk can and a child displaying extreme behaviours can as these are visual things but these are also things that can improve with age, therapy usually CBT and meds but not always so it's kind of a safety net and so legislation doesn't discriminate disability on children, it also had to be wrote into legislation for deaf and blind children as they are not always smi but they are VUW under different markers if that makes sense.
School can't lie or make things seems better for a child who is SMI or VUW they would always have things in place for the child they would have to say extreme behaviour, refusal to walk. Meltdowns need for restraint, hurting themselves or others, need for supervsion. All these things are usually written into education plans or risk assessments and that's what supports the claims for HRM but sometimes schools don't write things in supporting evidence they like to say the positives, schools also are under the impression that dla knows the child has autism so they should know the needs so again they stay brief so the DM has to call to ask about what's actually in place to support the child's needs and ask specific questions.. A child entitled to HRM under VUW or SMI can not mask at school it's virtually impossible so if school have no issues or plans in place the claim is refused. ( children can mask for other rates of dla the dla know this but not HRM)
Also just as a side note smi needs a formal diagnosis if its for autism, VUW doesn't. Xx

Edited

So children who mask won’t be qualified for HRM? My son doesn’t mask he doesn’t have the ability to do so, the way he is at school is the way he is at home

PositivityRipples · 17/02/2025 13:17

@Justanotherlove yes it's a massive grey area it's why DM contact the school because that could be one of the questions " does the child play nicely with peers" depending on how the school or parent expand on that answer would depend if the child meets criteria for the social functioning marker.
A diagnosis of autism alone does not mean the child has severe mental impairment but it does mean under legislation the child has an arrested development of the brain ( that's only 1 marker) it doesn't satisfy the other 4 on diagnosis alone the school or parent have to satisfy the other 4 with descriptions of how the child functions social skills or lack of, impaired intelligence, extreme and disruptive behaviour, unpredictable behaviour ect and the qualifies for HRC... If any of the other 4 markers are not proven then they look at VUW because the markers for that are different but do include some of the smi markers.
And yes school do lean on the positives which is why they are contacted because the DM will ask specific questions about behaviour, restraint and education plans and risk assessments.. All children who need positive handling in a school setting should have a risk assessment in place under the schools policy.
There's lots of factors HRM is complex under Smi and vuw. It's great that a child who doesn't meet smi on paper can still get HRM under VUW because the child and parent deserve that, yes it's a pain in the ass renewing the claim but no reason the child won't be awarded HRM again and for a longer length the next time 🙏💫

PositivityRipples · 17/02/2025 13:22

@UmElise Exactly that a child who is smi or VUW doesn't have the ability to do so.. You can't mask a severe mental impairment and you can't mask being virtually unable to walk there would be behaviour present to prove markers for HRM if the child masks these behaviours they are not smi or VUW xx

Hopping on to this thread! Hello everyone!
NC SD 10/10/24
Called last week for an update and just got a generic ‘the wait is 25 weeks so you’re looking at early April’ I’m hoping it’ll be sooner as I’ve seen others around my date who have had a decision so 🤞🏻
Although I am worried it’ll get declined.

Glitzxx · 17/02/2025 13:44

The wait is starting too annoy me now 16 weeks tomoz and havnt heard anything last time i phoned it was in holding queue for decision maker its starting to grind me down now not knowing where i stand i have a funny feeling it will be a decline

Nirzhara · 17/02/2025 14:05

Hi I think your application will be fine my application has been successful and my son also got diagnosed adhd.today I called that a decision has been made.then I asked him what is the outcome he said he can't say it but he can transfer me to who can tell me and he did and he said my son got middle rate of care and low rate of mobility

DR19 · 17/02/2025 14:06

Had a phone call today from dwp to clarify ‘night time’ needs, said I will receive a letter within 2 weeks. Anyone know how long decision takes once they’ve been phoned?

gezelligheid · 17/02/2025 14:12

I have a question, for HRM under VUW is this relating to outdoor mobility or indoor as well?

My son can't walk outdoors he can get to about 2-3 doors down before throwing himself on the floor and headbanging, biting himself refusing to move and thrashing headbutting me when picked up. He can run and climb indoors but he falls a lot and runs into objects, and also tip toe walks. He doesn't wear shoes for appointments or nursery etc and bites at his shoes when he has to wear them to try to walk outside. Due to all this he's in a pram but he's 3 so I don't think that's outside the realms of typical expectations itself.

I'm not sure whether this would count as VUW with it being outdoor mobility rather than indoor as well.

Hopefully quite soon for you . Not long if it's with the decision maker I imagine .

What was your scan date ?

Joanna8412 · 17/02/2025 10:59

Coc scan date was 27/09 but they are now saying its 30/09 meaning its 20 weeks exactly today.
just called and was advised to call back tomorrow as decision should be made at some point today. Asked if the claim was with a DM. And she advised at present still in the holiding que so id say no chance of a decision today.

My scan date is 23/09 for coc. I've been told very very soon and a few weeks yet so could be either. They both told me to ring after a few days. Doesn't make any sense

StaceSplatt · 17/02/2025 14:20

If I decision was made on Thursday, when can we expect payment for back pay?

My 3 year old is the exact same and unfortunately no matter how many times DLA state that this is normal for a young child it’s absolutely not! I have neurotypical older children all them was able to follow commands, understand dangers and pretty much able to navigate safely after the age of 2 years unless they are tired and need the buggy. Mobility is about navigating outside. Not indoors.

I might actually call today. They said at the end, thank you, you will receive a letter of the decision within two weeks. That makes me think a decision has been made?

zoeybrooks45 · 17/02/2025 14:37

Can we all collectively agree that DLA contacting the school for HRM is completely irrelevant, I personally don’t think any school will admit they are struggling with a child’s behaviour.
