I keep hearing this on this forum, but I am not sure if it refers to the old system or the new EHCP.

I am waiting for the draft plan for DS. (a new one, not a transfer from statement)

When I asked about hours, the LA told me that 'we don't do that anymore'

Are they correct? Are they supposed to still talk about number of hours, or i that the old way of doing it?

thanks

It might get to that stage, icimoi. But ill wait a couple of days to see if parent partnership can get any results.

Please excuse me, I need to say this

fuck fuck fuck fuck fuck

sorry.

I ask a plain straightforward question, I get an answer that means nothing, doesn't address this issue, and makes no bloody sense whatsoever!

I am soooo bloody angry.

Thanks.
I have calmed down now, but still frustrated. I want to see the draft EHCP before they send it to schools, as that is how the timeline published in the COP and the councils own documents say it works.

But the caseworker insists she will send it to me and schools at the same time, so I must name a school now. I want to be able to check it is correct before it goes to schools, but she is just saying no.
I know she cant do that, she must do it the correct way, but she is point blank refusing!
I have had parent partnership write to them, and advice from IPSEA, but she is still refusing to send it to me until I name a school and she will send it to them at the same time.

She also refuses to acknowledge that she has 20 weeks to complete the process in.

Can you complain or speak to the person above her? Sometimes it works. She sounds like a typical la employee complete idiot.

Aw no, so sorry you're having all this trouble just to get the help your DC needs Sad

Do you have the caseworker's remarks in writing, even as an email? If not, are you able to send an email to clarify this? I'm sure having a paper trail about this might help later on.

Obviously she's not above the law and in reality should be following the COP and be taken down a peg or two! but in the meantime, this delay in getting even the draft is delaying DS from accessing the support he clearly needs.

Is it likely the LA will refuse your parental preference?

Yes, I have e mails. they are so wordy and waffling that I barely understand them.
My Parent partnership worker has passed it to her manager, who who will speak to the manager at the council. Hopefully next week will be a bit more fruitful.

Write formally to the head of SEN setting out what has been happening and what the law is, and asking them to take steps immediately to comply with the law. If you've got reasonably sensible local councillors, it could be worth asking them to find out what on earth is going on and why this idiot can't comply with the law.

I doubt if the councillors will be interested at the moment, they are too busy with elections. I'll call her on Tuesday, I hope speaking to her might get some sense rather than e mails. She won't be able to evade my question so easily. If she does I will call the manager and escalate it.

You could try asking of SOS SEN will send a pre-action letter. If they're refusing to follow the legal requirements for the assessment process and refusing to comply with the time limits, they're acting unlawfully.
