we got the sen officer excluded from the hearing but it was a pointless exercise as the judge called us and the barrister in and made it clear that the LA would have an 'uphill struggle' to prove the case today - the judge was going on the 'Manchester' judgement which someone had posted on here and I had quoted in my case statement.

The Judge was quite clear with the barrister and then the barrister started twittering that if we applied for an EHCP our daughter would have met the criteria for that and they would issue one so after a lot of wrangling the barrister came back and the LA had conceded = we will be issued a statement within 3 weeks BUT then the LA are moving instantly to move to issue an EHCP - the judge has given us an extended time to appeal IF the LA play any further shenanigans.

the judge also made it clear that our DD was making it clear that she would struggle with a noisy secondary school and the LA would need to address that today which of course they couldn't as they only have mainstream schools available. the judge also made comment that dd wants a dyslexia school so we need to discuss that with the LA as the process for secondary placement continues. the judge also fired a warning shot that the autism had to be recognised today and was a legitimate dx and it did change everything despite the LA trying to argue it didn't

so thank you everyone - cost us a fortune in our witness costs and im sure theres another tribunal coming but that 3 -0 to us and 2 - 0 to us against this barrister - the judge and the panel member seemed lovely as well but again different to people Ive had before.

that's what most of the LA's do ineed - wait until the last day and often beyond...... I was 'lucky' that the LA offered in the hearing to do mine in 3 weeks = of course it came on the last day! and mine was just the NIL with the word statement at the top and they ignored all of the indie reports we had done as well.

as it stands now with just a few weeks to go the 'lawful' statement gives her less hours than the she had before the last appeal. if this statement had converted to an ehcp they would have not given her one on the basis it could be met under delegated funding.

as it is the WD which has most of her needs in now is going to cost the LA 30K - and they haven't included all the cost either! so yet again why is she left in her last year of mainstream with absolutely nothing but they will twitter to the judge shortly about all the support she will get in the future - lets not worry that we left her with nothing for the whole of her primary school and if she stays mainstream I expect lots of the support will be removed at the first AR as she will convert to an EHCP next year

think I may take the Manchester judgement with me again as I could argue that from January until today the LA have continued to ignore her needs.......

I am thoroughly pissed off today to be honest! I feel like all my fighting has been for nothing, Dd3 is going to be out of school anyway!! I wish I had taken her out in reception now and saved us 8 yrs of pain and fighting!!

well nothing has come so that's all good but the paperwork for her starting at the indie school in sept came - so no pressure on us then to get her a place there :-(

Ineed, how about sending the LA quotes from that bit in the Code of Practice which says that they should send statements etc as soon as possible, i.e. that they shouldn't routinely wait till the last day allowed? Preferably with the relevant bit in bold and highlighted. I know it'll probably won't make any difference but it's one of those things they conveniently ignore. You could also point out that every day they delay is another day your dd is being deprived of the help she's entitled to by law.

Thanks ici thats a good idea! Is that in the old code or the new one? We are stuck in the old one because of when our appeal was made [July 14]
