we got the sen officer excluded from the hearing but it was a pointless exercise as the judge called us and the barrister in and made it clear that the LA would have an 'uphill struggle' to prove the case today - the judge was going on the 'Manchester' judgement which someone had posted on here and I had quoted in my case statement.

The Judge was quite clear with the barrister and then the barrister started twittering that if we applied for an EHCP our daughter would have met the criteria for that and they would issue one so after a lot of wrangling the barrister came back and the LA had conceded = we will be issued a statement within 3 weeks BUT then the LA are moving instantly to move to issue an EHCP - the judge has given us an extended time to appeal IF the LA play any further shenanigans.

the judge also made it clear that our DD was making it clear that she would struggle with a noisy secondary school and the LA would need to address that today which of course they couldn't as they only have mainstream schools available. the judge also made comment that dd wants a dyslexia school so we need to discuss that with the LA as the process for secondary placement continues. the judge also fired a warning shot that the autism had to be recognised today and was a legitimate dx and it did change everything despite the LA trying to argue it didn't

so thank you everyone - cost us a fortune in our witness costs and im sure theres another tribunal coming but that 3 -0 to us and 2 - 0 to us against this barrister - the judge and the panel member seemed lovely as well but again different to people Ive had before.

wasuup keep gathering evidence, pestering school and live to fight another day. That's my plan. It might take me years but I will try again.

For now just rest but don't despair. It's not the final word. The final word is yours

Two government experts on special educational needs (SEN) visited the county council in December.

Two Ofsted additional inspectors, who also moonlight as SEN education consultants for local authorities, visited the county council in December. These inspectors last taught in the 1980s, have never had a successful outcome with a child with SEN, are totally ignorant of special needs law, but have the brass neck to call themselves "experts on special educational needs"

But the advisers’ investigation found no cause for concerns – and on the contrary showed that the county council had excellent relationships, good practice and dedicated staff.

The advisers didn't leave the comfy confines of the Children's Services' meeting room. They checked policies, checked data that would only have statistical validity if you were on mescaline, asked a couple of closed-set questions about inclusion, and read a few Ofsted reports, which were also written by additional inspectors with no experience or expertise in SEN. They didn't attempt to verify the information given to them by the LA, and they certainly didn't dirty themselves by contacting the people who triggered the complaint. OTOH, they had some excellent taxpayer-funded Fairtrade coffee and Belgian biscuits, and pencilled in a £400 per day workshop at the LA on co-production for the second quarter of 2015

Cllr Matthew Tomlinson, cabinet member for children, young people and schools, said: “I have always had full confidence in the professionalism and effectiveness of our SEN service but it is of course very pleasing to have that view confirmed by an impartial and respected agency.”

Cllr Matthew Tomlinson - who has an impressive title, but is basically what Lenin used to call a 'useful idiot,' said -"I have always had full confidence in the professionalism and effectiveness of our SEN service. This is because I am either: a) laughably unaware of what goes on in my SEN Service or b) irredeemably opposed to ensuring that children with SEN get an adequate education. It is of course very pleasing to have that view confirmed by an impartial and respected sock puppet, but if you think that you're getting "access to" this report, think again sonny."

Wasuup, I think the tribunal is keen for people to complete a survey about their experience of tribunal hearings. Sounds as if they need to hear about yours.

The anger and grief will never quite leave you. Instead, it will fuel lifelong and often successful efforts to protect many others (including your own family) from this awfulness.

The sh*t we had, in losing at tribunal twice, meant I genuinely could help 10 different people.

That was just today, and only 2 of them needed the full-on, jobsworth-ball-breaking, "Can I have that in writing? And your boss's name is?" Samurai Goose treatment a shame, cos revenge is sweet But 3 years ago, I simply wouldn't have known where to start.

And- your MP is truly fab.

Thank you for your support everyone :) Love your summing up Ugger of the newspaper article - maybe more on Monday in the media, keep an eye on twitter, when Nicky Morgan and Edward Timpson respond to a dossier they have been given of other peoples experiences throughout the country not just Lancashire.

well as its been inadvertently bumped thought it would be rude not to say what happened next...

the LA issued a dire statement so we lodged an appeal immeadiately, they then issued an even more unlawful 2nd statement so the appeal is of both statements.

LA would then wait until the dying weeks to even consult schools. 2 schools have said no as her needs so great so LA naming a dire mainstream school over 11 miles away which is Ofsted rated as requiring improvement.

Hearing for the 3rd tribunal now very close. LA have overnight reduced down their travel costs to half (very odd but showed how badly they calculated it in the first place) which means we could win this on costs alone. we are still going for specialist though

so basically everything the judge told them they just ignored and did the exact opposite.

its Saturday today so today is the day we expect the letter to come that they have instructed a barrister - sure I will be posting later if that happens!!!

so basically my intial joy lasted 3 whole weeks!!! its also clear now that if we had waited for the ehcp the LA were not going to issue one but we blocked that by appealing the statement

It just never ends does it!!

I bumped into Dd3's statementing officer yesterday and he said he wont produce Dd3's statement until the last day of the 5 weeks!! And it will just be the NIL tipped into a statement because he hasnt any new evidence!!

I dont care any more!! So long as it has the words Statement of SEN on the top I will be framing it !!!
