FAULTY PRODUCT INJURED MY CHILD AND COMPANY ACCEPTS FAULT

Hi,

I purchased an item from a well known and respected high street retailer. It was a furniture I purchased online and only used for a few weeks.

My little one went to sit on the bench and collapsed leading to an awful cut to his pinky toe. The item was ready to throw out but partner said no this should not have happened and need to be notified so i said ok.
Called the company to tell them item was faulty and broke and little one hurt himself. Immediately sent something out for the little one and requested for pictures of both the item and the injury sustained.

I then got a call few days later to say they would like to send someone out to inspect the item i said no problem. The man came and noticed a manufactures fault of the welding where it was loose and collapsed.

Today got a call saying that they would like to collect faulty item issue a full refund and offer £40.

Is that good enough considering the emotional and physical scar it has left my son who doesn't stop banging on his pinky toe and will only sit on my lap now to put his shoes on 😭

A small child with a scar on his toe is hardly emotionally damaged for life.

What sort of compensation were you wanting ?

RJnomore1 · 16/11/2019 00:37

Given you were going to just bin it I’d say that’s okay.

pemberleypearl · 16/11/2019 00:37

I think they've been decent. And I don't understand how your son is "emotionally scarred". He may well want to sit on your lap for a few days but he will get over it. Just give lots of cuddles.

Wildorchidz · 16/11/2019 00:38

Are you the Laura Ashley sofa poster from last night?

MaraScottie · 16/11/2019 00:41

Oh my God, are you for real?
Please don't join in on the compo bandwagon. Your son will be grand, no harm done. He definitely won't be emotionally scarred Confused

Elzemni · 16/11/2019 00:42

@wildorchidz no i'm not

OP posts:
Elzemni · 16/11/2019 00:43

@MaraScottie 😂 i won't i have never been like that hence why i thought i'd ask what is good

All I can muster is Biscuit

Elzemni · 16/11/2019 00:45

@ny20005 i don't know which is why i asked is £40 good enough i would never go to a claims company it's not as if his whole toe come off thankfully 😰

OP posts:
Elzemni · 16/11/2019 00:45

@Findumdum1 what is that a flower?

OP posts:
habipprtyh · 16/11/2019 00:46

Please don't raise your child like this.

Emotionally scarred my arse.

Elzemni · 16/11/2019 00:54

@habipprtyh😂 that scarring only last two days and hopefully by tomorrow he will
be fine but when you have four kids under 4 trust me last thing i need is a big boy to be sitting in my lap to put on his strapped shoes and a three year old and two year old making the two month old baby cry i think i'm
more scarred 😰😂

OP posts:
habipprtyh · 16/11/2019 00:56

I don't know why you are laughing?

You are the one who posted about emotional scarring. Don't be so fucking rude as to laugh at people for responding to it.

Elzemni · 16/11/2019 01:02

@habipprtyh no no hun don't get upset i wasn't laughing at you i was laughing at myself don't get emotional it's not that serious i asked a question therefore open to all sorts of responses and comments 😁

OP posts:
habipprtyh · 16/11/2019 01:03

I'm not emotional 'hun'

Elzemni · 16/11/2019 01:05

@habipprtyh very well then. you didn't say you think £40 is reasonable do you? considering he didn't break his ankle but still
hurt himself from a faulty item the accept liability for?

OP posts:
HappilyHarridan · 16/11/2019 01:12

You can’t claim compensation for things that might have happened

Elzemni · 16/11/2019 01:16

@happilyharridan oh no it did happen he got a deep bleeding cut on his little
toe

ffswhatnext · 16/11/2019 01:17

@Elzemnin even before you explained, I could see you were taking the piss out of yourself. But of course, humour is hard to do over a screen.

Anyway, back to the post. £40 is a decent amount. No lasting harm. They know there's an issue. They should do a recall and you are free to tell everyone what product it is.

Of course, it's unfortunate that someone did get hurt.

Mjlp · 16/11/2019 01:18

You're being ridiculous. Of course it's good enough. It's very generous of them to offer £40 as well as a full refund.

that scarring only last two days

Well then its not a scar, it's just a cut. You child will not be scarred physically or emotionally from a cut toe! Hmm

HappilyHarridan · 16/11/2019 01:33

Exactly he didn’t break his ankle or come to any serious harm

Elzemni · 16/11/2019 01:45

@ffswhatnext nice to see you understood it was humour. very well guy thank you all for taking the time out to comment nothing to serious of course. A friend said i should take it further that's all and found it a bit much as i'm not that type of person to get on the compowagon so thought i'd get an opinion

It's just a daft thing you ask yourself as a sleep-deprived parent.

It's after midnight. And at least one of the four young ones is clearly keeping you awake.

SD1978 · 16/11/2019 03:09

£40 is reasonable. There is no scarring- there was a superficial toe cut. Any further issues are being perpetuated by you, not because of the initial incident.
