My child was hit by a pen, thrown by a teacher

So my daughter who is in year 8 was in a lesson when her teacher 'cold called' her a question. My daughter responded she didn't know the answer and the teacher then threw a highlighter pen at her, hitting her on the arm. The teacher then did it again to another student, also hitting them on the arm. We have reached level 2 of a complaint, but it's always investigated by management within the academy. The school keep down playing what happened and not investigating what we ask. This teacher is still teaching, although my daughter isn't going in on the day of that lesson, which is greatly affecting her attendance. The school said they would move my daughter so she could do a different lesson (double Maths or double English), but we said no! This feels like a punishment to our daughter. She wants to do that lesson, just not with that teacher... and we agree.
Any advice on what/how the school legally should be handling this? Happy to answer any further questions Xx

No. I just have the common sense to understand that a pen being thrown to a pupil is a complete non event.

While teachers obviously should not throw objects at students (except in the aforementioned question ball type situation), if your daughter was so emotionally shook by this she refuses to go to those lessons then you have much bigger issues. Most children would just laugh it off.

She's refusing to go in because she's embarrassed about your over reaction.

She could have spent that one hour elsewhere. Instead you refused to accept a compromise and kept her home. Well done for her not being able to answer even more questions.

OP, can you not see how ridiculous this is?

The teacher made a stupid attempt at a joke/game/whatever. You have complained to the school that your child didn’t like it and that should be the end of it.

I’m sorry, but if your child doesn’t feel safe because she got hit by a frisbeed highlighter pen to the arm, then she really does need some professional help.

In my day we had a lot worse than that, hit over the head with a board rubber, you either got the hard side or the dusty side,and chalk thrown at you

For any reason? A number of people have commented that a toy or a ball is sometimes used as a way of choosing who will answer. It adds a bit of fun as the kids are keen to be the one to catch it. Is that not OK either?

I agree that it doesn’t sound as tho that was the case here tbh and I have also said that the teacher should apologise. You are hardly getting a pack of wolves response. Whatever that is.

The other child who got hit also has gone on to say she was told to only write about my daughter and not herself.

Reasonable because you complaint concerned the incident with your child.

Yeah, sorry but I think you are going a bit over the top here, keep it in proportion.

Your daughter needs to tackle adversary and the unexpected. I'm not condoning what the teacher did but it needs to be relative to the situation. The teacher doesn't deserve to be hung, drawn and quartered over this. You have made your point and fired a warning shot. Now let it go and send your daughter back to school for the full week.

Changing teachers isn't going to happen.

I've previously accidentally hit a child with a pen. They get an apology and move on with their lives.

I'd file this under "mildly annoying" and get over it tbh.

How did you manage that?! I've been a teacher for over 10 years and I've managed to never hit a child, accidentally or otherwise.

I think you'll find many teachers put up with this every day, it certainly would not lead to a suspension.
