My child was hit by a pen, thrown by a teacher

So my daughter who is in year 8 was in a lesson when her teacher 'cold called' her a question. My daughter responded she didn't know the answer and the teacher then threw a highlighter pen at her, hitting her on the arm. The teacher then did it again to another student, also hitting them on the arm. We have reached level 2 of a complaint, but it's always investigated by management within the academy. The school keep down playing what happened and not investigating what we ask. This teacher is still teaching, although my daughter isn't going in on the day of that lesson, which is greatly affecting her attendance. The school said they would move my daughter so she could do a different lesson (double Maths or double English), but we said no! This feels like a punishment to our daughter. She wants to do that lesson, just not with that teacher... and we agree.
Any advice on what/how the school legally should be handling this? Happy to answer any further questions Xx

I'm a teacher and have done that before as well, with various objects... the person with the item asks the question and throws it to the person who answers. It's a bit naff tbh but I can't imagine anyone getting in touch with LADO over my rubbish classroom game!

I think you probably need to home school @Tiredallthetimelaura because your expectations of what is and isn't acceptable in school are way beyond anything even private ed offers.

There will be one music teacher. She either does it with her or drops music. Her choice. IF I were you (I wouldn't be, because this is a total non-event) I would pull her out of music and get a private music tutor instead.

It was a female teacher. She threw it at her the way you would throw a Frisbee. It didn't leave a mark as she had a blazer on, but emotionally she was shook up and embarrassed! The whole school ended up talking about it.
Regarding moving lessons - this happened in a music lesson, she wants to continue to do her music lesson. Why should she have to move to do English or Maths, as she did nothing wrong. Nightmare in covering teachers or not, the teacher should have not thrown something at my daughter, hitting her.

A frisbee? So with enough force to throw a featherweight disk? In a game?

She’s having a whole day off school a week so she doesn’t have to do this one lesson?!!
Time to build some resilience.
In the 90s teachers regularly threw chalk and blackboard erasers at kids who weren’t paying attention - agreed it’s not really acceptable but there are many worse things in life.

She was asked a question, she said she didn't know the answer and THEN the pen was thrown at her.
No I don't work in the school, I reached out to the parents of the kids in that class and asked them if they could ask their child if they remember an incident regarding my daughter in music. The parents all replied back.

So, under the guise of doing a survey about the teacher's behaviour, you have created a scenario of gossip and Chinese Whispers. Neatly done, OP.
I really wonder about the "She said she didn't know the answer". Parents never believe that their little darlings would ever be capable of an answer that is far from neutral or friendly in tone. That their Wee Precious could actually be rude or surly or disrespectful. "She just said she didn't know the answer". OK then. That would never generate such a response from the teacher had it been polite. There's a backstory here and evidently the OP is encouraging the other parents to gang up on the teacher....presumably to get her sacked. Who would be a teacher these days, eh? Do you not realise that good teachers are being driven from the profession by this type of bullying? Good luck with your kids getting a first-class education, then.

You go to higher than the head teacher . Look
up the head of the education board for that area.

If you get no Luck or even if you decide to to the police .
This is not acceptable .

pretty sure if you throw something in anger at someone, "like a frisbee" is not the way anyone would do it 😂

Waiting for the OP to backtrack now, and saying it wasn't like a frisbee after all, but like an axe - like you would in an axe throwing venue

That’s probably because the school don’t know either! They’ve just accepted this teachers version of events and covered their arses.
