Can my child be put on study leave?

School called Friday, said because of two incidents at school of my child being rude to a teacher, following what my child said (no excuse I know) was a very stressful maths exam, that they would be put on study leave. This means that they cannot go in to school for anything other than their exams. Neither myself or my child want this.

Everything I have searched on the internet doesn't help explain the position. As far as I can see the school are under an obligation to provide my child an education until the last Friday before June following their 16th birthday. Where a child does want to go on study leave, they must receive permission from the school. I guess they have an option to suspend my child but there is no indication that they are doing this at this stage.

Seems to me then that they cannot put my child on study leave but anybody know where I stand on this point?

@robotchez , as this is Mumsnet, it has taken 4 pages of replies before you got the right answer to your original question (from NobleGiraffe). I was about to send you a link to the guidance but can see she's already given you one.

That's not to say that some of the more judgemental replies don't hit the nail on the head. 🙂 But some gave misinformation - I noticed one that said your son might not get into sixth form if he misbehaves. This is wrong. State school sixth form must follow the admissions code - though colleges are exempt (and of course private schools do their own thing). His current school sixth form must admit him if he meets the academic criteria, unless he is permanently excluded. He should not need to "apply" as he is already enrolled at the school.

Other school sixth forms will have oversubscription criteria for external applicants, but they can't include behaviour or attendance considerations. If they do, they are illegal (meaning you would have solid grounds for appeal if refused a place on the basis of behaviour reports). Hopefully this answers your question about what it might mean to have a temporary exclusion on your son's school record.
