The answer is no. Dominic Cumming's wife writes for this rag and she writes articles which are simply not true and made up.

TeaSoakedDisasterMagnet · 07/08/2020 12:22

This sentence here should tell you all you need to know about this article

“Most controversially, part two of the Bill pertains to the offence of ‘stirring up hatred’, which criminalises anyone who ‘behaves in a threatening, abusive or insulting manner’ or ‘communicates threatening, abusive or insulting material to another person’.”

What exactly is controversial about stopping violence and hatred?

LizzieMacQueen · 07/08/2020 12:50

There's another thread running on this, I'll do a link.

In essence too many influential groups are onto it; hopefully it'll get kicked out before too long. Much like the awful named person legislation.

LizzieMacQueen · 07/08/2020 12:54

Here's the other one, in feminism chat.

Andrew Doyle takes aim at SNP

WaxOnFeckOff · 07/08/2020 12:55

I already had a thread about this and it is horrifying. It's nothing to do with stopping hate crime, there is already legislation there to deal with that. There are many many reputable organisations out there that are against this, including churches, secular societies as well as political organisations and the police who say its unworkable.

There is also at least one thread on the feminism board.

There are plenty of articles on other newspapers if this one doesn't please.

It's named person's all over again. I think the police indicated that it required them to please people's thoughts.

I've no desire to get back into arguments with the SNPs special envoy to MN though so I've said my piece, as they have, and maybe let some other people share their views as ours are pretty much already known.

Iggi999 · 07/08/2020 13:42

It feels like a world away now but I remember filling in the consultation for this and was fairly horrified at some of the thought-police type phrasing.
Also, misogyny still not an issue - no hate crime against women. Why?

Moresandwiches · 07/08/2020 14:45

It doesn't cover violence. But it does cover being "offensive or insulting" - whether intentionally or not, in the view of anyone, however unreasonable that view. You can be sent to prison for up to 7 years for saying something that one person finds "insulting", even if no-one else would find it insulting. And that includes saying something that someone might think is insulting that's in a play, because, you know, you're playing a character who says something that someone somewhere might just possibly find insulting (whether reasonably or not).

OP posts:
WaxOnFeckOff · 07/08/2020 14:47

Or even if you say something that that person doesn't think is insulting but they think that others might....in your own home...

Moresandwiches · 07/08/2020 14:49

And it covers something that someone thinks is insulting or offensive, even if you say it in your own home. This really is straight out of Big Brother - your teenager may shop you to the police and subsequent imprisonment for giving them your opinion on cross-dressing over a meal at home, for instance.

OP posts:
WaxOnFeckOff · 07/08/2020 14:50

And yet, someone could call a child a fat specky bastard or a woman a dirty whoring cunt but that's okay as it's not under the criteria?

Moresandwiches · 07/08/2020 14:51

What can stop the SNP from doing exactly what they want, though? They really don't care about sanity / justice / privacy/ the Arts?

OP posts:
WaxOnFeckOff · 07/08/2020 14:52

More I was about to say the same thing re your own teenager or whatever, can you imagine trying to discipline a wayward teenager (not that I have one!) and then they threaten to report you for saying something negative about a protected characteristic, whether you actually did or didn't as it would be their word against yours.

ssd · 08/08/2020 09:29

Can anyone explain this to me in a nutshell, I don't have time to click on the link and read it just now.

Iggi999 · 08/08/2020 10:42

SSD
New hate crime bill.
No hate crime! = good, but criteria for designating something as a hate crime is basically anything that could cause upset to the feelings of anyone else (except women obviously as we don't count) = bad.

MumofHunter · 08/08/2020 11:02

It explicitly says the sex of a person is one of the categories of hate crime it covers.

Moresandwiches · 08/08/2020 11:24

It doesn't cover sex. The Scottish Government have stated this very clearly:
"The Bill includes an enabling power to add ‘sex’ to the Bill’s lists of characteristics.
This could be done at a later date, by regulations, once the Bill has completed its
passage through Parliament and attained Royal Assent."

In other words - shut up women. Let's get the bill through and then we'll forget about sex (of course there'll be masses of protection for transgender people).

Moresandwiches · 08/08/2020 11:27

If, in your own living room, you have a row with your teenager and tell them that you think that teenagers are little shits, they'll be able to report you to the police for a hate crime, with a maximum prison sentence of 7 years.
If you have a row with your husband and tell him not to be such a boring old man, he can report you.

OP posts:
MumofHunter · 08/08/2020 11:59

Ah I see , they're creating a separate bill for misogyny.

I can't see anyone's husband calling the police for being called a boring old man. Or a teenager for 'little shits'. Hate crime against shits? 😂

Goingdownto · 08/08/2020 12:07

When? Why?
Why separate? That comes under the "I'll believe it when I see it" category indeed.

MumofHunter · 08/08/2020 12:17

While Lord Bracadale, in his review of hate crime legislation, recommended that gender should be added to hate crime law, leading women’s organisations were strongly opposed to this approach. They proposed a standalone offence on misogynistic harassment be developed, which the Scottish Government is committed to in principle. A working group will be established to take this forward and consider how the criminal justice system deals with misogyny, including whether there are gaps in the law that could be filled with a specific offence on misogynistic harassment.

Seems pretty logical.

Moresandwiches · 08/08/2020 13:06

Any husband or teenager would have the right to call the police in those circumstances, because a crime would have been committed. It sounds ridiculous because it's a ridiculous law, which needs to be stopped.

OP posts:
Goingdownto · 08/08/2020 15:46

Sorry what? Why would the proposal be to add gender? The protected characteristic is sex, which is easy to define, unlike gender which everyone has a different view on! I need protection based on my sex. That should be obvious.

AnneOfQueenSables · 09/08/2020 06:42

The entire bill is a disaster. I don't know any SNP members in RL that support it and it's one of the issues tearing the SNP apart atm.
There's a horrible undercurrent of its real purpose being to intimidate people into silence if they disagree with GRA proposals, etc. And, of course, they missed sex off the list Hmm
If you asked a bunch of misogynists to come up with a policy this is what they would produce and we know that because it fails women in all the same places as Twitter's policies do. And we can see from Twitter that this type of approach is weaponised against women and supporters of sex-based rights much more than anyone else.

Calledyoulastnightfromglasgow · 09/08/2020 06:46

The devil is in the detail. This proposed legislation its implications is terrifying.

Calledyoulastnightfromglasgow · 09/08/2020 06:48

I am Scottish - generations back - my ancestors fought for independence. I no longer feel like I want to live in my country. The SNP are disastrous in every sphere they meddle in. My DH and I are strongly considering a move south once the DC are off. I am not alone in this. Many, many feel the same. The SNP has become a cult
