Ex threatening to share videos

My awful ex is becoming ever more embittered by our breakup. Stupidly when we were together (during lockdown) we exchanged sexual videos. He is now threatening to share them with people I know.
I told him that this would be illegal and his response was to send me a particular clip he says he will share. It is obviously a sexual video but you can't see anything obviously sexual. Sorry if that isn't clear, but essentially my question is would it be illegal to share it?!

I am really anxious about him doing so and would like to go to the police or someone. Or at least have some legal backup. But it's hard because the video doesn't actually show sex or my genitals. Any advice?

Yes the videos were consensual but clearly they were for his eyes only.

My only concern about going to the police is that I don't want the police seeing the video! That's why I thought it best to threaten him back first.

Put it this way, if he actually went ahead and did it, there would be more people seeing it than the few officers who would probably deal with it.

It's illegal, immoral and weak - you must contact the Police, (and possibly) a solicitor to warn him of the consequences of such treachery

Intimate image abuse or 'revenge porn' is when someone shares, or threatens to share, intimate photos or videos of you without your permission.
It is a serious sexual offence. If someone does any of the following without your permission, it's intimate image abuse:

  • posts intimate images or videos of you
  • sends the intimate images of you by text, a messaging app (like WhatsApp), social media, or e-mail
  • shows someone a physical or electronic intimate image of you
  • shares edited or fake images or videos of you, like deepfakes, that appear real

Section 69 of the Domestic Abuse Act 2021 created a new offence of threatening to disclose a private sexual photograph or film in which another individual appears, where by doing so, the person intends to cause distress to that individual, and the disclosure would be without the consent of that individual.

When a person is charged with this offence, it is not necessary for the prosecution to prove that the photo or film referred to in the threat exists. They also do not need to prove, where it does exist, that it is a private sexual photo or film. In other words, the threat of sharing a private image without your consent is enough!

You do not need to share with the police the photos or videos your ex is threatening to share. You only need to show that he is threatening to share images in order to cause you distress.

In the extreme, this conduct could lead to a custodial sentence. You don't deserve this; you should report it to the police. Good luck!

I'm alright thank you. I didn't go to the police but I made it clear to ex that if he threatened me like that again or did as he threatened, it would be a serious offence even though the video wasn't actual sex. This shut him up. I just wish I could know he's deleted it.
