One bed flat during separation with 2 children

Is it deemed suitable to have an 11 year old and 8 year old living with me in a one bed flat, me on the sofa them in the bedroom in a double bed and air bed, for 50.50 custody in the short term until my ex buys me out of our house? I will then get 200k equity and be able to afford a bigger place. I'm concerned the courts could find this unsuitable and so deny me access. He will stay in the family home with them so they have a familiar base. We have savings and equity so I won't be entitled to benefits except child benefit.

13 year marriage, 19 years together. I earn 1k a month part time and he earns far more. I have savings but am worried about getting into financial difficulties hence looking to rent a small manageable place initially. Also looking for a better full time job. I'm a qualified teacher but currently working in a support role. I'll have to give up my lease car as it's on his company benefits so have a small search area for rentals as need to be near their school which is on the same campus as my work.

I will get financial advice ASAP but am currently out of the country on holiday.

Please be kind. Very upset today. I e never dealt with financial stuff before.

Otherwise, as PP said, he can contribute to the cost of a 2-3 bed rental.

Why should he move out ?
if the OP is the one who wants to separate and both parents are equal care givers ( sounds like it ), why should he leave? , if the reason is simply because he is a “he”, then that’s not a valid reason at all.

Because he's by far the higher earner and can comfortably afford a 2-3 bedroom rental. Because I'm guessing he has a car that he won't have to give up, so he can be more flexible than OP when it comes to the location. Because he works full-time and OP works part-time, so I'm guessing she looks after the children slightly more than he does.

However, OP has said that she wants to move out, so that should be the goal in the long term, it's just wise to consider whether it's the best option in the short term.

Are the children both the same sex? At that age it wouldn't be suitable fir a girl and boy to share a room.

You hate the house but you are uprooting your children from the home they love.
It is easier for your husband of 1 person to move to a small flat, and you stay with the 2 children in the house until he buys you out.

The courts will look at what is in the best interest of the children ? Is it in the best of interest of the kids to move them from their home where they have their own bedrooms to a smaller flat ?

Could you not do it that you stay in the home, and when its your husband's turn to see the kids, for you to just check into a nice hotel for a quiet weekend to recharge ?

Is moving to a smaller flat in your interest or the kids best interest ? That is what the courts will probably look at. Get legal advice first.
