Solicitors letter now sent to H..... I'm awaiting the aftermath!

Saw my Solicitor today and explained everything about H and how he had been behaving over the past 3 weeks.

His letter to H goes something like this:

My client informs me that the marriage was abusive, it ended with you being convicted of assaulting my client and you have continued this abuse through text messages, phone messages and a letter left in the marital home.

This must not happen again or I will be forced to take legal action against you which, as you can appreciate, will be extremely costly to you. You will also be entitled to cover the legal costs of my client.

My client wants this resolved as quickly as possible as I'm sure you do too.

My client proposes that you sign over all rights to the house to my client, you return the car and pay my client £360 per month to cover half the child care costs.

In return my client will take on all the marital debts.

With regards to access to the children, my client leaves that to you to make a reasonable and realistic proposal for regular access, which my client will consider.

You have 10 days to respond to this. If I have not received a response in that time scale I will advise my client to take action through the courts.

I trust you will accept these conditions and would like this resolved as soon as possible.

Divorce proceedings will commence after.

What do you think?????? Think he'll be angry?? Pleased???

Another update for those still tuning in. He's back at work and staying with his friend near my parents. He's in contact with them and told my Dad today that his deferred sentence was for him to show he can behave. If he behaves and sticks to the bail conditions then the charges will be DROPPED! WTF???

I'm not dropping any fucking charges. He has also decided to take his day of on a Friday to spend time with the kids when my Mum watches them...... meaning I still to put them in an extra day and he has completely no responsibilities whatsoever. I'm LIVID.

AND I went to Tesco today and he's cancelled his staff discount card that he left me. Meaning I was treated like a thief in front of everyone including my children. I'm going to rip him apart in court. Hope he's ready.

can i make a suggestion that you open another account to recieve money from you ex, i am a bit concerned that if you give your account details the he might fleece you.

How can he fleece me? He can't do anything with a sort code and account number. I work for a bank.

Procurator Fiscal in Scotlan COd - but principle is the same. The PF can drop the charges against mr exTootht if he wants to.

in Scotland, however, in a sheriff court, cod, you are right, the sheriff most often acts as lay magistrate in his/her own right.

altho, of course, they are overseen by procurator fiscal.

i would think, however, that as toothy's ex's offense is seen as minor, it would indeed be a matter for sheriff court.
