Odd find, secret DLA allowance....

sooperdooper · 19/05/2012 10:27

I live with my DP, we're getting married later this year

I was just doing some tidying up, and sorting out a pile of paperwork/letters etc on the kitchen table, putting stuff in the pile to shred/file away etc

And I've found a letter, to DP from the DLA, about Disability Living Allowance, that he's getting nearky £400 a month on a higher rate care & lower rate mobility allowance - which I had no idea about whatsoever? Confused

I wasn't snooping, just sorting through what was important and what could be thrown away, it wasn't in an envelope, just in with other letters on the table

I know his in his family there is a medical history if disabilities - his brother has spina biffida & learning difficulties, and his sister has spina biffida but works normally although I know she does suffer a lot of pain sometimes & has had so many ops over the years to enable to her now live a fairly normal life

But he has never, ever told me her receives DLA, it's so strange and I just don't know what to think

He's at work today and then going to a friends tonight from work, I won't really see him until tomorrow, but this is just so odd

I don't even know what advise I'm looking for really, guess I'm just confused

glastocat · 21/05/2012 10:33

odd thread, marking my place to hear the outcome.

ClaireFromWork · 21/05/2012 11:00

Very strange. I hope there's a reasonable explanation.

Queenofcake · 21/05/2012 11:50

I am also wondering if the OP has managed to get to the bottom of this yet.

davidsotherhalf · 21/05/2012 15:02

dla would be sent to the person who is disabled not the person who fills the forms in unless they are under 16, op says letter was in her dp name, he was at work, (can't claim dla if able to work) i think it's benefit fraud.

CheeseandPickledOnion · 21/05/2012 15:15

marking.

carernotasaint · 21/05/2012 16:05

And i think its very unlikely to be benefit fraud because they wouldnt give high rate care to someone just like that. My friends son is 23 years old with severe learning difficulties and wears incontinence pants DAY AND NIGHT.and can not get high rate care. He is on middle rate. The OPs partner would have had to have had a medical done by Atos and there is NO way he would have passed it based on what has been posted here.

cestlavielife · 21/05/2012 16:08

you can claim dla if able to work . DLa is not incapacity benefit.
it is non means tested but high rate would be for someone in need of a agreat deal of help from anothe person.
so maybe needs a personal assistant on hand in order to be able to work

"Disability Living Allowance and Attendance Allowance

Disability Living Allowance (DLA) and Attendance Allowance (AA) are for people who have a disability and as a result need help with personal care (care component) or getting around (mobility component) or both.

The allowance is to help with the extra cost of personal care (for example, washing, dressing and bathing) or for supervision or getting around. It does not include help with activities such as shopping or housework.

Entitlement conditions

DLA and AA provide a non-contributory, non-means tested, tax-free contribution towards the extra costs of severely disabled people. Payment is not affected by income or whether a person is in employment.

carernotasaint · 21/05/2012 16:16

I know that cestlavie. But there is NO WAY that the OPs partner would have passed the medical to get high rate care based on the information given here.

mirry2 · 21/05/2012 16:19

sooperdoper how long have you known your dp? I think you can get DLA if you have a terminal illness even if you're still active and working. Is there any chance he has one? Sorry to be morbid about this.

doormat · 21/05/2012 16:20

interesting thread

Greatauntirene · 21/05/2012 16:23

My neighbour got DLA and was able to walk the dog and take bus to shops but possibly had been less well previously.

Perhaps he claimed at a time when he was disabled but has made a good recovery but never informed DLA. From what is seen in the Daily Mail headlines I would be anxious about informing them in case they made demands for vast sums in repayment. Maybe that is his problem.

5inthebed · 21/05/2012 16:31

You don't have to be wheelchair bound to get DLA, and nor do you have to have a visual disability Hmm

Shall I paint DS2 purple just so people know he claims DLA despite looking like any other child just to make otherss feel better?

cheapskatemum · 21/05/2012 17:02

As posted earlier, you don't HAVE to have a medical to get higher rate care component. Sad at carernotasaints' friend & son.

carernotasaint · 21/05/2012 17:31

My DH had to have a medical to decide on his LOWER rate care.

cheapskatemum · 21/05/2012 17:33

I guess things have tightened up of late, but if the claim was originally made a while ago, it's possible no medical was needed.

carernotasaint · 21/05/2012 17:34

My husbands medical was in late July 2006.

fanjoforthemammaries7850 · 21/05/2012 17:36

YOu can still walk dog and take bus to shops if you get DLA

Alameda · 21/05/2012 17:38

I don't think I've ever, in past decade or so, had a medical for DLA, used to get high care and low mobility now middle rate (but still with mobility component) despite writing to them and saying 'I don't need this, there is nothing actually wrong with me' they just did it all on evidence from doctors. Day to day am not sure I seem all that severely disabled either.

AmberLeaf · 21/05/2012 17:41

Prime examples of why some people think disabled people are on the fiddle!

DLA is not an out of work benefit and you are able to have a dog and go to the shops on a bus if you get it!

Alameda · 21/05/2012 17:45

yes you can have a dog, horses . . . I think I remember a thread about someone on DLA who had horses and all the 'how can you be disabled and ride a horse' stuff, it really got my paranoia muscles twitching

thisisyesterday · 21/05/2012 17:47

agree with hecate. i think it's really incredibly unlikely that this claim is genuine... you would know if he needed higher rate care.

ds1 gets middle rate care and lower rate mobility, he is autistic and looks like any other kid! but he needs a lot more help than most.

i would imagine though by adulthood he wouldn't be eligible as he will hopefully have learned the "rules" of being out and about and will be less prone to giant flapping tantrums in car parks Grin

my initial thought was that it was actually meant for his brother and that they've just got the name wrong.
or that he was claimed for and it's been renewed but he no longer needs it...

BrittaPerry · 21/05/2012 17:48

My first thought is that you get higher rate automatically if you have a terminal illness. But that is with very little time left - hence why they speed it along. When was the letter dated?
