Buyers not paid for oven!

Hi,

Small thing but really annoying. Home buyers agreed to pay for freestanding oven which I left. Not much - market second hand was £350-400 and they pushed me to £200 - annoying, but saved me moving it. But they have not paid a week later!

Was a rushed completion and only arranged last few days via (useless) estate agents as solicitor said not part of their remit.

Now what? Shall I go to their solicitors? They knew what they were doing I think!!

When I sold my house the oven was about 4 months old. £700 new. It was just included with the house. I’d let this go. You don’t actually want it.

Agree with this! Find it very annoying that people try to get money especially if you have been a good buyer.

lol that’s the problem though - the ball is in the buyers court therefore why would they be motivated to do anything? OP doesn’t seem to have anything legally binding and buyers know this so even if they did get contacted they’d just laugh and ignore her! OP just needs to live and learn and move on imo.

The OP is asking for suggestions as to how she might recover the money for the oven. She not asking for people's opinions of her wish to recover the money.

I am suggesting that she try reminding them in the first instance to see if they have any intention of paying at all. They may have forgotten. Maybe not but its worth asking. Do you know these buyers ? You seem to be very certain of their views and feelings on the subject..

Its of no help at all for all and sundry to say 'oh I would never have done that! Just suck it up and move on sweetie.'

When you arranged to sell it to them, did you arrange how payment would be made? If it's not going through the solicitor as part of the offer it would need to be a separate payment, so they'd need your bank details or to have arranged to give you cash.

I would start by either reminding them of whatever was agreed or, if those details weren't ironed out, just send a letter/email/etc. via the estate agent asking for payment and telling them how you'd prefer it.

Most likely it's all just been really hectic and slipped their minds. Moving is one of the most stressful life events that most people experience.

You sound controlling. People are going to give their opinions, on the entire situation, you can't stop them whether you like it, or not.

@Un4732 are you using the word “oven” but actually mean a freestanding cooker, such as a range type cooker?

Once completion has happened, and you've moved out and they've moved in, you have very little leverage left.

I am absolutely dumbfounded how so many people seem incapable of reading the OP. THe buyers wanted it, the buyers negotiated the price down to 200. THEY now own the oven, and the OP doesn't have the money. Why would you assume that it would be difficult for her to take. She said it is free standing, and was relatively easy to move. Not built in. It is totally irrelevant that you think she is unreasonable not leaving it. Clearly the buyers (whose opinion is the only one that matters in this instance) wanted it. The OP's query is how to deal with this. Not how mean she was for not leaving it. Of course people can have an opinion, but it would be good for them to also at least mention something that shows they read the whole of the OP's initial post.

For me, I would email them if I have the address. If not, then I would initially drop a note in with the bank details and my contact details. If I hear nothing, then I will knock on the door and ask them directly if they had forgotten to pay.

That is so helpful. It was free standing, not built in. Therefore most people will remove items like this. What you negotiated with your seller is great. But of zero use to the OP.

Well she should of took it then before completion or made sure she got her cash no good whinging about it now is it OK

Should have. And some punctuation would have made that easier to read. The fact is, on completion you don't get to meet the people selling. The sellers drop the keys to the agent and the agent hands them over to the buyer. From my perspective, the money is owed, as agreed by all parties. Glad I didn't have to deal with people like you when I sold my house if you think agreeing a price for an item, then refusing to pay for it, is acceptable!

Drop a note through the door with payment details, reminding them.

If you get nothing there and you have proof that they agreed to buy it seperately to the house purchase you can go through small claims though I probably wouldn't bother.

You're right but that sale item is not part of any sale contract. No contract - no enforcement. Verbal / casually written email agreements are moot.

Not particularly. But it is important, as punctuation does make posts easier to read. Otherwise the meaning can be lost or people just don't bother to read a post as it is too difficult. In addition (rightly or wrongly) correct grammar and punctuation can make people appear more intelligent that they actually are.

You don’t have a lot of leverage - your option is to collect it if they’ll give you access but what if they don’t? Drop them a note asking for the money again and forget about it if they’ll give won’t engage. Next time add it to the TA1.

OP if you are local, I would literally turn up at the door with a big cheery smile, ring the doorbell, and ask when they will be paying, or when you can collect your oven.

We had the opposite problem. Seller told us she was leaving us the washer/dryer. We said we didn’t want it as we had one that was almost brand new. Told the solicitor to make this clear. She left us it anyway so then we had to arrange getting rid of it.
