To withdraw from the sale or not?

Maybe asking the question suggests it's time but hey! Open to suggestions.

I went under offer in June 2024 it was hard to get a slot for the mortgage evaluation but I figured that's normal because it was summer. In November I discovered the sellers solicitors had been off sick and almost no work had been done on the file the estate agent was reluctant to step in and say c'mon sort it. The seller is older and not the type to push as she struggles with the tech of everything (EAs words). We had an issue with the survey as well. December comes we have exchange and completion dates for January.

The EA was reluctant to let me have a pre exchange eventually a face time viewing happened the seller was not packed or packing up 2 weeks ago

On Friday I was notified our completion wasn't happening and further up the same and me decided on the 31st I checked with the EA she said she's fine but it's not convenient and I thought you're lying, the EA have a habit of lying.

The 10th of February has been floated around but my mortgage offer expires on the 31st and it can't be extended the bank have said no.

My head says pull out due to the impact on my mental health (I'm not sleeping etc) but my gut says Im best to put a new application in as there's nothing this cheap and that ticks my boxes on the market in London.

But if anyone has any wisdom please share!

This all sounds very hard work and she’s clearly not arsed about selling and her agent is taking the piss.

I would be walking away on the basis of their attitude.

I think it's hard because the EA are difficult and don't tell the truth so it's hard to know how much is the sellers fault. The seller's solicitor is also pretty unresponsive

I think I'll feel some relief if we could at least exchange, the seller is purchasing her new place with cash

I don't understand her "financial issues" then!

Maybe she's just waiting for you offer even more stuff given you offered a lot more than you need to already?

There's nothing more I can offer, she agreed to the sale price, I've offered to help her pack, source a removals van and/or storage as well as paying for the cost of her moving from London to her new city (this would cost about £2.5k)

The cash comes from the sale of her property

Ahh ok.

She's not a cash buyer as such. Just a person who won't need a mortgage once her house is sold.

I've emailed the sellers solicitors director and I'm posting a letter signed for by 1pm to the sellers tomorrow so she'll get it on Tuesday.

I feel less stressed knowing it's not much longer until Monday!

I said that to the estate agent and she said oh but let me just try and chase the seller and see what is actually going on as my solicitor is under the assumption she is fine to complete on Friday.

Solicitor has just messaged me asking if they have my authority to exchange on the 31st and I asked does that mean we're exchanging now and they said I'm trying to sort it

You will need to both exchange and complete on 31st if your mortgage offer runs out that day? The solicitor should be advising you on this, they all sound utterly hopeless.

My solicitor can be a nuisance, but they're not that bad. I can't exchange&complete on the same day.

Well then the 31st won't work will it. You need to have a valid mortgage offer at completion not exchange. And you won't have one so they won't release the money.

Tell your solicitor and the EA that they've got until 5pm tonight to confirm exchange is happening tomorrow or you are pulling out. Then when the deadline passes, which it will, follow through, because I don't think the seller has any intention of selling this week or next or even in Feb – possibly because her kids are living in the flat and are refusing to budge – but she wants to be able to say you pulled out to future buyers so it doesn't look like the problem is with her.

Also, you have to complete by 31st to keep mortgage deal. So sorry, but that's never going to happen.

Just rang my solicitor he said he's triggered the release for exchange of contracts and it comes up the chain to come back down? Hes given them until 5pm today

That's right. You've signed, now he sends it on for them to.

What will you do at 5pm?
