To withdraw from the sale or not?

Maybe asking the question suggests it's time but hey! Open to suggestions.

I went under offer in June 2024 it was hard to get a slot for the mortgage evaluation but I figured that's normal because it was summer. In November I discovered the sellers solicitors had been off sick and almost no work had been done on the file the estate agent was reluctant to step in and say c'mon sort it. The seller is older and not the type to push as she struggles with the tech of everything (EAs words). We had an issue with the survey as well. December comes we have exchange and completion dates for January.

The EA was reluctant to let me have a pre exchange eventually a face time viewing happened the seller was not packed or packing up 2 weeks ago

On Friday I was notified our completion wasn't happening and further up the same and me decided on the 31st I checked with the EA she said she's fine but it's not convenient and I thought you're lying, the EA have a habit of lying.

The 10th of February has been floated around but my mortgage offer expires on the 31st and it can't be extended the bank have said no.

My head says pull out due to the impact on my mental health (I'm not sleeping etc) but my gut says Im best to put a new application in as there's nothing this cheap and that ticks my boxes on the market in London.

But if anyone has any wisdom please share!

Congratulations on completing! That is a massive success.

If you haven’t already, speak to your solicitor about the boiler. You may be able to recoup some of the costs from the sellers. No guarantee - I’m no expert. But your legal documents may have specified that the boiler etc were as seen (or as they were at exchange - which the sellers have acknowledged it was working then!).

If the state of the house is particularly bad, you may be able recoup clearance costs etc. But sadly a lot of people don’t attempt to clean when they leave, so that’ll come down to how bad it is.

Has he managed to fix it? At least you’ve identified the leak immediately.

He wouldn't fix the leak because the seller had told him not to

The advice I've been given by my solicitor is these issues the seller has known about which I have proof of therefore he's going to pick it up on Monday because this isn't my issue to fix.

I'd be surprised if you have any recourse regarding the boiler. If the surveyor said in their report - boiler not looked at, you need a professional - then you'll have to sort it yourself.

When I moved there was a hole in the roof that the surveyor missed so they had to pay to get it fixed because they'd said they'd investigated and the roof was fine.

However, the boiler was fucked, but the surveyor said they hadn't looked at it and recommended an engineer check it over, which I didn't do, so it was up to me to sort it out.

It's not about the seller knowing about it. It's up to the buyer to find these things out.

I think it depends on whether the seller has deliberately misled you or lied on the documentation you have received. If this is the case and they are awkward and refuse to pay, you would need to take them to the small claims court.
Unfortunately, this seller has been trouble all the way through the process and has continued to be so.

My solicitor has dealt with similar before and said it's usually fixable through evidence (which I have)

Plumber has been and said she's just had lots of really bad jobs done which has created these issues
