Patio too high

We are in the process of having the garden landscaped. The landscapers completely removed the garden, levelled it and started putting a new patio in. Having looked at it today I see they have done the ground level higher than it was previously. This was never discussed with us. More worryingly I think it’s now too high and will breach the proof course. The gardener says it’s fine as there is a gravel border to soak away water. Except the bricks are still wet at the bottom so I don’t think this is adequate.

What are your thoughts? What would you be asking for at this point?

Then let him do that , if he refuses to do more you stand more chance of winning in a small claim situation if you’ve let him do it . Let’s face it he can’t make it any worse . When he claims to be finished email again with the outstanding issues and get a response in writing / email that says he is finished and it’s all ok .

I’ve got 2 reports from 2 different professionals now, both of which say it needs to come up and be relaid and I’ve got a third coming to see it today.

Keep us posted!

So visit today agreed with the first 2 and said it needs to come up.

The patio has actually started sinking in some areas, due to the incorrect base.

He has said we could technically leave it in place and fix the visible issues but that he has no doubt we will have more problems in a few months if it’s already sinking so quickly and so he would recommend it all coming up.

He also spotted something I haven’t before in that the pattern of the tiles goes wrong towards the edge of the garden as he hasn’t done the half piece at the start of the row.

If we don’t take it all up and redo it, he has recommended installing drains along the house wall as the patio doesn’t have the required fall away from the house and will cause water to pool once fully grouted and sealed. He also said he wouldn’t guarantee the work if we chose this option as it would still be laying them on a substandard base.

I’ve asked him to quote for both options and once I’ve got that through am going to contact the original landscaper again with the 3 quotes and 3 reports all stating it needs to come up and see what he says from there.

Hope you get it sorted @ImagineRainbows

@ImagineRainbows “am going to contact the original landscaper again with the 3 quotes and 3 reports all stating it needs to come up and see what he says from there.”

Seems reasonable. Have you posted anything yet in the legal section or over on Reddit diyuk or the uk legal pages?
If the original company persist with only replacing to or three chipped slabs, no point in letting them back on site. What about that inspection chamber? That looked unfinished.

Any update?

ImagineRainbows · 09/02/2025 18:14

It needs to completely come up is where we’re up to. It’s getting worse every day and is sinking.

We’ve sent the list of issues to the people who did it and the reports and they haven’t replied. No answer on text, email or phone so I guess they have gone back to ignoring us.

Going to cost a lot and we don’t have it right now but have put a section 75 claim with the bank so will have to wait and see what comes from that.

@ImagineRainbows did you get any joy with the section 75 or have you had to go down the legal route?

Still waiting so don’t know yet. It can take up to 12 weeks I’m told. Original contractor has since blocked me on social media media and phone so I’m guessing they have contacted him as part of the process. Have also sadly found out speaking to someone about our experience that he has done this before and in fact recently moved into my area and changed his company name due to his appauling reputation in the area he comes from.
