Last minute delay for completion nightmare

We are supposed to be completing today but our lawyers IT system is completely down and they have been unable to transfer the money. Has anyone experienced something similar and what happened next? Our sellers just rung us panicking as they have had all their stuff packed up and we have loads to deliveries booked to the new house tomorrow (whiteware, furniture etc). We are bottom of the chain - will be liable for everyone’s costs even if it’s our lawyers fault?

Emma Emerald - Barclays covered essential expenditure. This covered hotel stays, meals, change of clothes, toiletries and extra removal costs. In my case I stayed with family so no hotel but the extra charge by the removal company was around £1500.
I paid for insurance which I thought would cover delays like this, but it did not. Receipts were essential and all costs had to be paid for upfront before reimbursement.

Has anyone had any update from Setfords today at all? Or perhaps how the issue might be progressing in general? I only hear that completions are being delayed further due to lenders stopping some transactions,,, feels like it’s getting worse

I have had confirmation that our remortgage is likely to complete on Friday as scheduled (thankfully). OPS are up and running (albeit very slowly). They have a backlog which may cause delays. Even though we complete Friday there is a slight possiblity the funds may not clear until Monday/Tuesday. However, this is because of the backlog and not due to the system.

Unfortunately, I don't know the in's and out's of it as this information is coming directly from my mortgage broker as OPS are still not responding directly to customers. However, all employees are working overtime to catch up on the backlog.

Hopefully this may give some of you some reassurance, particularly OPS. I can only hope some of the others are up and running as well soon.

Thanks to everyone for the supportive comments and advice! I knew moving house would be stressful but never dreamt it would be so bad.

I really hope everyone else caught up in this nightmare manages to get a resolution soon!

i just got off the phone from my solictors. They are ditching CTS and securing a new platform system provider. CTS in breach of contract with them so they are in their words “ dead in the water” They just need to get the lender panel to approve their new system and they will be back up and running, hopefully a few days. There say stage 1 of the approval has gone through today.

I suspect most solicitor firms (apart from maybe the really big ones ?) are doing this as if they wait for CTS to be back up, then they have to assume lenders will trust them using CTS, then they have wait for CTS to get through the backlog and CTS will be in breach of contract with them.

I think they have been waiting to get this far before being able to communicate that.

Hope that’s some reassurance that cogs are turning in the background and firms are finding solutions

this is my 9th move over 40 years. Hopefully my bloody last! They are not all as bad as this! In fact, I’ve never experienced something as bad as this. Sorry we’ve all jumped on your thread, but you’re not alone. In my experience it works itself out in the end x

I think that’s good news. Conveyancers need to vote with their feet. In this day and age,this situation **really shouldn’t happen

It’s so frustrating as the conveyancer I’m using has not been in touch with me at all. I’m seeing updates here and it’s giving me hope but other than me calling them on Monday there has been zero communication. Even on their website there’s no recent update

I was told late yesterday that there is a slim chance that we can still complete today - I won't know until some time this morning (they did say early...)

Unfortunately, my removals have understandably said that it's too short notice to get a team together, so if it does happen - does anyone have any tips for securing removals at such short notice?!

I have thought about asking my buyer for a days grace, as this isn't my fault, does anyone know if this can be done?

Or shall I just wait and panic if/when it happens..?

I just don’t understand how firms cant have some sort of back up plan. I called and was told still absolutely nothing they can do and to check again on Monday. I feel like I am being fobbed off at this point as from others updates here it seems other companies have been able to come up with work arounds

I think so. Although I have an email from my new bank saying that any charges or additional costs will be paid by the solicitor. So I'm hoping that includes the interest hike that'll hit us for however long it takes to get it sorted. I'll certainly be arguing that!!

Me too! Zero from Taylor Rose and diddly squat from the useless mortgage broker. The new bank called to tell me. I'm not even their customer yet, and they've been better than anyone!

we have been emailed today and told that we won’t be completing tomorrow. (Taylor rose) No update by CTS as to when this will get resolved.
How on Earth can companies dealing with this sort of life altering / extreme importance events not have any back up plan for if the software falls over- for any reason!
What worries me is these companies have every details of our lives- bank accounts, home details, passport copies, signatures, proof of addresses- the lot. Yes they say ‘no reason to think the data has been compromised’ but in reality I don’t believe they have any clue if it’s all been stolen.
If you are a company collecting with this kind of data and large sums of money you absolutely must have security banged down tight- number 1 priority above all else. Or your company is dead and as are your clients possibly. Completely ridiculous and outrageous. There hasn’t even been any communication - just everyone left in the dark

I really feel for you all not knowing when you will complete and move. Moving house is already stressful enough without this.

I had seen this thread so was aware of the issue but had not given it more than a cursory glance. But I just called my dad's solicitor to get the original copy of his will as he has died and have been told by reception that their databases are also down due to this issue and they might not be able to locate his will until this issue is resolved.

I imagine the strong room where they keep documents is pretty large so there is no will section where they just go and find my dad's will alphabetically filed. But am quite amazed that there is no back up file available to them showing where they have stored legal documents. Without CTS they seem to be utterly lost!

Setfords told us that they are in the process of building their own case management system. However, they don't yet know whether the notes on the old system will be carried over or not! They will only know once they have the case management system, likely to be early next week. I asked what's the plan if the old notes aren't transferred across, and I was told they don't have the answer now, have to see what's like next week! More waiting.... we are going into the festive season, even if we appoint new solicitors, this will be delayed into the new year. Anyone has a better idea?

Just an update for anyone with ONP. Our mortgage funds landed today from the lender and we have been advised they can now send completion monies. We will be completing tomorrow, 1st December!

So glad this is all over. It's been torture, but hopefully, this gives some home to others also using O’Neill Patient Solicitors!

Meant to exchange today, then find out the bottom of the chain is with Taylor Rose. Hadn't said anything all week that they wouldn't be able to exchange and it turns out they hadn't even sent title to their client. Now no idea what is happening. I feel so stressed

My vendor is with TR. we were meant to exchange 23rd Nov. I fear those that haven’t exchanged yet are waaaay behind the pecking order as delayed completions will prob be dealt with first. We are a chain of 5. Vendor is in the middle.

Our completion date was today and has now been missed. We've been told not to expect any further update until next week. We exchanged a long time ago..

I was told there was a slim chance today, now I'm being told there's a slim chance tomorrow (no removals now) but after that my mortgage funds have to be sent back and reapplied for.

My buyers solicitor is still unable to draw down their funds.
