How long is probate taking right now?

We’re in the process of buying a probate property. We are not part of a chain ourselves and the solicitor said we should be in a position to complete by end of April. However I asked her to check what stage probate was currently at and the response from the vendor’s solicitor is that application for probate has been drawn up but not yet submitted. I also saw this ad in the paper which got my hopes up that perhaps we’ll be close to completion towards end of April but no idea if that’s the case or not really. Any recent experiences to share? My solicitor said probate is currently taking ten weeks from submission . It’s mainly so we can get our builder booked in so that work can start once we’re the legal owners.

Well an elderly relative died in May 2021 and probate was granted in January 2022 so I would take that all with a large pinch of salt. (We were told September 2021 originally).

The people who told us 6 months to a year were correct.

Personally I stay away from probate sales unless it's already been granted.

Just sold my late parents house and probate took about 8-months.
Nothing special, was fairly straight forward.

If it’s a ready for submission (solicitor handling it) does that mean it’s just a case of waiting for the probate office to process it? We’re on as we’re not in a chain so time isn’t too important - other than being impatient and liking to have all my ducks in a row

If it hasn't even been submitted yet you're in for a long wait. I'd factor in a year to completion and if it comes in at 8-9 months you're ahead.

I posted on the other thread. I think a year to get a grant of probate, when it's a simple estate, is crazy.

I started the process right at the start of January did a lot of going through and sorting paperwork myself first before passing it onto my solicitor and we submitted on 3 March. So more or less two months, and now just waiting the eight weeks for it to be processed. I can't see why it would take so much longer for simple estates.

All I know is that I’m at the bottom of a chain and I’ve been waiting to complete my purchase since August. I can’t move, my sellers can’t move and their sellers can’t move because the property at the top of the chain is a probate sale, and probate hasn’t been granted yet. I don’t know when the probate application was submitted, to be fair, but my solicitor was ready to complete last December.

This probate application is supposed to be the most straightforward of cases, but it seems that the probate office can’t be hurried.

Next door went through probate March last year and our new neighbours are due to move in next week. My best friend lost her Dad April 2021 and probate is still in progress :( different areas if that makes any difference?!

I did my Dad's probate all myself as sole executor last year. It went off in late March and was awarded in early August so just under 5 months. It wasn't extremely complicated but not completely simple either.

I found the probate office quite frustrating but once I'd established that they'd put my claim on hold (they don't always tell you which isn't helpful) because they hadn't received IHT details from HMRC I chased repeatedly until they chased HMRC and it wasn't long after that that I received the grant.

Yes all we need is grant of probate so I fail to see why it should take that long once submitted. I’m not questioning how long until the deceased family get their share.

I think the probate case I mentioned was put on hold, because the probate office were “waiting for a document”. They’d been sent it two months ago and when asked to check there and then, they found it.

I submitted an application for probate on 1st March. I phoned the probate office this morning for an update, and they are playing a recorded message that states they won’t even discuss if they’ve received an application until it has been in their system for 8 weeks!
There’s no way you’ll be moving in before summer in my opinion. We will only be putting the house up for sale once we receive probate.

We're seeing some grants come through at work now from people that died in January so there is a chance (although don't get your hopes up too much!).

I submitted my application for Letters of Administration (same sort of thing, I assume from the same office that Probate is dealt with) online on 27th Feb. Returned the death certificate as requested a few days later and it was returned on 7th March. No updates yet.

We put in for probate at the end of November. We have had a tax bill through and a letter asking for details of the property (which we had already sent) but nothing else yet.

God job we’re not in a hurry then really. Happy to wait as it’s definitely THE house. But would be nice to get somewhere before the mortgage offer runs out in September and we have to go through the process again.

Inheritance only took a few weeks after probate was granted in my case. That was the quick bit.

Everyone fails to see why it takes that long - it just does.

Oh dear. In which case I’ll try not to get too excited and actually put it to the back of my mind for a bit. That way I can’t be too disappointed.

But why though? I did all the grunt work, waded through years of paperwork, statements, receipts etc, submitted online myself, no solicitors involved.

What do the Officials at HMCJS do with the application that takes so long?

This ad relates to what you are advised to do before you apply for probate. You are advised to give other people with claim on the estate 3 months to come forwards ie potential dependents, creditors etc. So it may be that they won't submit the form until the period is up.

We sold my mother's property before probate was granted. The solicitor has the money though.
