Are they taking the piss?

We got the phone call today around 1:30pm from our solicitor to say we had completed on our new house (FTB) and we can go to pick the keys up from the sellers as we now own the property.
(online EA so we pick keys up directly at the house from the sellers)

However, we've been in touch with the sellers over the last few days keeping each other up to date etc, on Tuesday she said her EA said it would be anywhere between 10am-5pm for them and their new house.
Today she messaged at 1:45pm and said 'just had the call to say the sale is all complete :) just waiting on our new property now' ... she still hasn't messaged to say she's ready to hand the keys over. Yet, they've had a moving van parked outside for a week now (we just live down the road so often drive past).

Are they taking the piss? Should she have handed the keys over as soon as the sale was complete? Are they allowed to stay and wait in the property until their new house is ready?

Nope it's yours. Go round get the keys and tell her to leave. They are essentially trespassing. It's not your problem that there new property isn't ready .

It's awkward because the EA is online, so we collect the keys directly from them (the sellers) at the house.

It’s yours now. We had to wait outside our new house for two hours a month ago while our sellers sale completed; with all of our things, because our buyer legally owned our house and so we had to be gone.

The direct communication between you & your seller has probably made them think that you won’t mind waiting… but you’re not privy to why there’s delays. My sellers sale took two hours longer than ours, his sellers took a few more hours and didn’t happen until nearly 6pm!

They are in your house. You need to knock on the door and ask for the keys.

She will know this and is just stalling for more time.

(Also, our estate agent wasn’t online and we could have got the keys from them, but we got them from the seller as we were outside the house… it’s not that unusual, don’t overthink it Smile)

You call your solicitor and ask them to have the keys courier to you or left with the EA
Your solicitor calls their solicitor to discuss vacant possession.

She hasn't said they're staying - just reply and say 'great sale has gone through, we're on our way now!'

Short answer to your question is yes!. We had to sit in a cafe for a couple of hours when our sale completed before our purchase. They don’t own the house any longer but have just received a large sum of money in payment so now the have to give up the keys - the onward purchase is their problem!

Just text her saying your solicitor has said that now the sale is complete you need to take ownership of the keys for insurance reasons, and tell her, not ask, that you’ll be round at x o’clock to pick them up.

It’s bullshit like but she’s having a laugh.

Go knock the door and ask for the keys and off they pop. Not your problem any more.

I bought a flat and on turning up ah hour after completion he hasmdn't bloody packed. 6 extra hours of my removal chaps time that twat cost me. Cheeky prick.

I thought as much. I bloody hate confrontation and such an empath! They have 3 kids, one is only a few months old and I keep finding myself making excuses for them.

I know rationally that house is mine now and they need to p*as off basically 😂

Yes it’s yours and they need to leave. I’d text and say the you’ll be round at 5pm to collect the keys and lock up after them.

It doesn't need to be a confrontation. Just go round all breezy and start moving in. They'll soon get the message.

You need to go round and start moving in. They need to leave and if they have to sit outside their new house waiting to get in than that's just what happens.

I sat in the EA waiting on our keys while DH sat outside our new home in a van watching the previous owners clear out. He got the keys directly off them eventually bit I think his hovering hurried them up a bit. (Mind you had to call them back to clear their crap out a built in wardrobe they had forgotten about!)

Wow now they really are taking the piss!

We messaged them and said 'we completed 2 hours ago and have plans tonight so we'll be round at 4:30pm to collect keys'

To which they've responded 'sorry we had no control over getting the keys so late, got them now but we've got to unload our belongings and still have another load to put in so no way will we make 4:30 but can aim for 6' ??????!!!!!!! 🤬

Yep, breeze in and start moving stuff in. If they object, tell them to take it to their solicitor.

All of which is true by the way! Supposed to be dropping DH off for an event 20 mins away by 5pm, got a toddler who needs feeding and bathed tonight!

Start moving in as they're moving out. Simple.
