Restrictive covenants.

Ds is a home owner. Got home at the weekend and ndn has massacred his overhanging tree. No chat /discussion. Not just their side but right over the fence into his property..
Back story if anyone cares...
There is a huge gap which is fenced but now they /he can see right through. They have a patio set facing into his garden now!
Deeds say party fencing due to restrictive covenants..
Can ds attach reed fencing to it legally? Can't be sitting out there in full view!
Anyone help?

Whose tree was cut?

What do you mean there is a fence but they can see right in?

What does the covenant say. Exact wording.

Sunnydayshereatlast · 29/06/2020 17:15

Ds's tree. Deeds say any wall or fence erected is a party /joint fence. Payment of such and upkeep must be shared..
I am not with ds now so not word for word. Ndn been there years and posts on their side. Very gappy fencing.

Not very clear OP.

What are you asking? The tree was over hanging and cut back - my understanding is he can cut back to his border.

Regarding the fence - you both have to maintain so if you want to put something up I'm sure you could? Not sure why the covenant applies

I just want to put reed fencing over the gaps without a saga starting with ndn.
