Neighbours's Pole

Not a euphemism!

We have had various issues over the past year with our neighbours. This was resolved briefly when I approached the wife and we agreed to put these issues behind us. This led to a few months of ignoring each other but no problems which was fine for us. However this has started up again recently.

We have adjacent parking spaces and my neighbour started storing a large animal run on his space right up against the line separating the spaces. This made it harder for me to navigate into my space so we started moving the run away from the line however they kept moving it back. I even hit the run at one point as it's so awkward.

Now the run has been replaced by a pole right on the edge of the line on their side. I can get in and out but it's awkward and as I hit the run fear I will hit the pole.

My partner tried kicking the pole to dislodge it and it came loose but sadly we couldn't remove it and it has now been put back in.

Do we have the right to get it removed? I don't want my car being damaged or my neighbour suing for damage to the pole (he's that type). I can't approach him directly as he harasses us. Only today we saw him up in his house and he was watching us go out and I think filming us. I stuck my middle finger up as we left in our car Grin hopefully he got that one on his phone!

Although I think putting an animal run on a parking space in a car park is a bit strange, you sound more of a nuisance than them tbh

The car park is owned by everyone who lives in that area I think. I don't have the deeds as I rent.

Yes HangryCaterpillar he put it there just to wind me up. No reason to put it on the boundary line.

So you caused damage to their property on their land? And you wonder why you have issues with the neighbour. You shouldn’t be moving their run to park in your space, get a smaller car if you are struggling.

If your space is to the right of the cage and pole then I don’t see what the issue is. You wouldn’t park right against the pole anyway, or you wouldn’t be parked centrally in your space. I think you’re making an issue out of nothing because of previous issues.

No it's a private car park so he is still parking in the car park. It's a new build estate and about 10 houses all use the car park.

WTF? Have you spoken to them about it? Maybe they are confused and think you are parking in their space or something? It really looks like they are doing everything they can to stop you parking in that spot.

They know we aren't parking in their space, they just want to make life hard for us. I don't want to speak to them about it. They are not reasonable and won't take the pole down unless ordered to do so.

So you damaged their animal run, then the bollard to stop you hitting their animal run and they’re the problem?

If they’re parking across the “road” from the space they’re doing no harm n they’ve left you plenty of room to get in unless you drive a tank.

I hope there’s nothing in that run after you’ve whacked it

If you rent speak to your landlord. They will let you know if you are right or wrong!!

If it’s a shared area, they may not be allowed to put anything like that on the drive. I know a lot of the new builds have weird regulations.

I lived in a new build apartment development with a car park. We owned out place so had he deeds. An animal run or bollards would not have been allowed, it was for cars only.

A car park is a stupid place for an animal run. Particularly if you keep hitting it. Poor animal (is it a dog?).

Three issues

  1. Speak to the management company, check the deeds. Neighbour is probably acting outside the rules.
  1. The probable is the way he parks means you can’t swing into your space. Speak to neighbour and explain this.
  1. Stop trying to remove the bollard, you are aggravating the situation.

Also, should have said if you have concerns about he welfare of the animal contact the rspca.

Looks like the other car is blocking your parking space - is there a management company who can put no parking signs / double yellow lines to stop blocking your space?

Although I don't want my neighbour to park there if it was somehow brought in that you can only park on designated spaces it would leave no spaces for my visitors. My mum is over nearly every day and parks in between my car and his. This only blocks me in so doesn't cause an issue for anyone else but technically she isn't in a space either.

Okay then with no management company you need to see the deeds. Enforcing the deeds might be difficult, your best bet would be to explain why you are having trouble parking on your space when they are encroaching on it. The issue is how they park their car, which makes it difficult to swing in.

If they know it was you who damaged the parking bollard you might want to apologise.

They will know it was us but they have no proof. I won't be apologising as they are doing it to be difficult - AJPTaylor is right there!

Re - putting my middle finger up, although I was driving it was on the private car park so surely the law won't apply as I wasn't on a public highway?

If you have issues parking in that space you may need to consider some parking practice. Can't see how the pole or the run would cause issues.

Tbh I think your are being too aggressive in your approach to this.

You don’t know if they are doing anything wrong by putting this stuff on their parking spot- it’s within the line and yet you deliberately damaged it. You haven’t checked the deeds. Your mum parks every day in the same way they do.

I would almost think this is a reverse?
