Can't Sleep. Chain collapsed while moving today.

So... I've got a stinking cold and can't sleep. Currently in a Premier Inn as we have no bed or anything in our house.

Last Friday we were told by top of chain move on 19th or it's off. We'd put up our Xmas tree and everything by then. To be fair on top of chain, they have cancer and are scheduled for treatment Jan 2nd so fair enough.

So we packed up our 3 bed home.

Exchanged this Wednesday to complete yesterday on Thursday.

Yesterday, 2pm rolls round nothing. Turns out first time buyers of the flat (flat are buying our house) had a completion statement through and there was a shortfall of £3k which hadn't been accounted for. It was to do with leasehold management fees for the block of flats.

Bottom of chain didn't have the money. They had to beg relatives but eventually got it to their solicitors and the money for everything started to move up through the chain.

By this point top of chain served notice down the chain for breach of contract and failure to complete on allotted time slot.

Solicitors at bottom and solicitors of flat are arguing who's responsible.

I believe our solicitor won't accept monies unless they include the interest for what has been charged. And neither will the solicitors above.

We're hoping to get it resolved tomorrow.

All the money for the chain is there apart from the interest charged as a result of breach of contract.

Why can't we all move in an solicitors argue in January?

At this rate the whole thing collapses and no good comes if it.

Oh what a nightmare for you so sorry. Unlikely to happen in Scotland...different laws about buying and selling.We sold up there and moved to England. MY son and I bought a second house for him and were gazumped after I had upped my offered and it had been agreed. Then their sale fell through and she then wanted me to complete instead. I went back to my original price and said take it or leave it because I had found another house ready to walk into but more money. After 6 weeks she took it.I wasn't going to be a mug twice.

Hope it gets sorted tomorrow.

I know this is most unhelpful but staying awake ruminating about it all isn’t going to change the outcome tomorrow. Try and be kind to yourself and allow sleep to come.

Awake with a newborn so my thoughts may not be the most profound but just wanted to say I’m sorry. That’s so hard and unfair and frustrating. We bought this year and it’s a bonkers process. I’m hope fully for you that it will be sorted tomorrow. Sending luck x

Hi OP, try not to worry - it will all be fine if the money is there today - it probably just didn't arrive in time yesterday for everyone to sort things out.

If completion doesn't happen it's standard to serve a notice to complete as that starts the clock running. In my experience people won't take the point on interest but if people are genuinely out of pocket and claim then it's the fault of the person who caused the problem. Now the monies are there it should all be fine tomorrow.

Thank you everyone. Trying to sleep but I've got a stinking cold on my chest, probably a chest infection brewing. Spent the evening outside our possible new place with our removal men because no one knew what was happening.

We were told it was all go at 4 ish you see.

Man at top of chain unofficially moved into his new place, lady above us unofficially moved into his. We were trying to get her to at least let us unload our van load into her garage as its not got a door into the house.

I can't remember if she said we could unofficially move in or not in the end. Even if we could we would still be in a hotel as we'd have no bed set up.

Going to try and sleep if I can stop coughing. Xxx

Also fills me with horror as we're due to complete tomorrow. Should have been 2 weeks ago but there have been all sorts of problems up and down the chain.

Currently in a cold, uncomfortable B and B and hoping not to have to spend Xmas here!

We're also Ttc atm but my cycles have been getting longer and longer and my last AF was end of October... I'm not pregnant as numerous tests have shown... About to be assessed for all sorts of stuff like thyroid issues, PCOS, early menopause etc so have that on my mind to! Maybe it's the universe saying we probably won't need the family home anyway 😐

Problem is its recommended to have the blood test on cycle day 3...but as my periods have stopped God knows when that'll be Hmm... I've been told to wait another month before cashing in the blood test and if there's still no AF get it done regardless.

This would have been my worst nightmare when I used to work as a Legal Assistant for a Property Lawyer. Hopefully your solicitor will resolve this and you will get compensation (costs for staying in a hotel and storing furniture etc)

try with lots of pillows behind you so it doesnt feel so heavy on your chest an things go downward.couple of painkillers might help.

I had a money shortfall but before exchange twice. The worst was when the mortgage advisor left us 13k short (10% of the property value) and walked away. That was in 1999. Luckily family was in a position to lend us the cash and we could then reimburse them a couple of weeks later. In my experience mortgage advisors attached to estate agents have been crap.

As the funds are now all in place, I really hope the seller backs down. Flowers

I just wanted to say don't give up on the TTC, I had longer and longer cycles and lots of negatives. I had a period in October 2015 and then nothing...
But somehow conceived DD on the 27th of December.

I know it makes no sense - but you never know.
