Help!! Builder has done a runner with my money

Hey everyone,

Just after some advice really, we started a big project with a builder back at the end of February. We found him on my builder and he had good reviews etc met him a few times and had great discussions about our plans etc.

Anyway he started out ok with the footings etc we paid him 25% of the cost up front and had the ground works done, he asked for more money and we paid him, brick layers started and the work became very slow, we were both at work from very early until 7pm so didn't see anyone but could tell that not much was happening with regards to the work that was planned.

Basically he's had £110,000 from us ( that's not the whole amount we agreed at the start, but a huge chunk) and is now completely avoiding us and practically ghosting us, ignoring calls and messages, every time he's supposed to be here he has a family emergency or is away for a few days etc, he told us previously that he's paid for windows, internal and external doors roof lantern, roof tiles and all carpentry plus other stuff. The last few times he's asked for more money I've had to refuse and insist that he gets the current jobs completed first.

In the last month we've had about two half days of work done. He keeps promising that bricks are being delivered but they never show up.

He lives fairly local to us and I just can't understand why he would behave like this. I've since found out that he hasn't paid any of the tradesmen, brickies, groundwork's or carpenters, even though he's taken over £100000 from us. He gave break downs of where all the money was supposed to be going and I paid him by bank transfer.

He is registered at his home address as a limited company, and I'm terrified that this means that not only will I never get the building works completed but that I can't claim against him if he simply decides to fold the company.

At the moment we are living on a building site which is stressful enough, but the reason for the extension was because my husband has numerous health conditions and needs easy access accommodation with a wet room etc. I can't even let my dog out into the garden because it's not safe.

There's no way I can afford to get the work completed by someone else as I had to double my mortgage to get the money to pay for this work, equally I can't face living like this for the long term.

Does anyone have any advice, obviously I know in hind sight I shouldn't have handed over so much money, I trusted this guy because he seemed so professional and had good reviews on my builder but has since deleted his account with them.

I don't even know what I'd say to him if he did show up, I'm so upset and dh really doesn't need all this added stress as he has so much to deal with at the moment with his health.

Get off MN and get to a lawyer!
With those sorts of sums you need proper legal advice.

I think you’ll get better answers if you go to the legal section and repaste your query there.

Did you get anything in writing (including emails/texts) regarding what he would provide, and the timetable?

@BuzzShitbagBobbly I am in contact with a solicitor, I know that I have to get a quantity surveyor in and find out what the work that's been done is actually worth. I also know that solicitors fees are £££, I can't afford to lose the money I've paid out plus £££ to a solicitor.

I just wanted a shoulder to cry on really 😔 life's hard at the moment because dh is really unwell, not terminal but he has health conditions that really affect every day life and I don't want to keep on at him about this because he doesn't need the stress.

I'm so worried, the whole idea of the building work was to make life easier.

@Bumblenut yes we did, he gave us a contract, and we've had had money requests via email outlining payments etc and a payment structure.

He hasn't stuck to any of it other than the initial groundwork.

I know it sounds dramatic but I would contact rogue traders or diysos as well as proper legal advice.

@TheQueef - I know, I'm so sad thinking that someone could do this, we certainly aren't rich and you can see that by looking at us. I can't get my head around it to be honest.

My poor kids and husband living like this because someone thinks they can spend our money on themselves.

@CamdenTownie it is shit, and I feel really bad for you, you must be sick with worry.

But you can get a steer on the chances of success without paying all the £££. It's spending a penny to save a pound. At least worth finding out.

Honestly get local media involved as well. The local papers, the local TV station. Shame that bastard until something happens.

@BuzzShitbagBobbly that's what my thoughts were, I'm getting a letter sent to the builder from the solicitor in the hope that he will realise it's not on.

He's got a brand new 4x4 since he started with us and is apparently getting married soon, so I can guess where my moneys gone.

I hope there are some kind of repercussions for behaving like this but I have a feeling that he will just dissolve the company and I'm left to pick up the pieces of his crappy attitude.

@sheshootssheimplores I'd love to but we just aren't tv kind of people, I feel so embarrassed, really really stupid, but I have no experience of anything like this and genuinely thought I'd done my investigations and found someone decent.

The problem was I kept paying him because I was worried the work would stop and I just wanted it done.

I've got some money left, but not much considering how much I've already paid out, we also had a holiday fund, dh had surgery a little while ago and we had planned a family holiday once he was fully recovered, but it's looking like this will be eaten up by legal fees too.

Never mind not being TV people, if it could help it's just a means to an end. Get a quantity surveyor round and get the ball rolling.

Don't feel stupid! The last thing you do is try and blame yourself.
I would hate tv even though I suggested it but this fucker has taken a load of money and the piss. Speed is important as he's spending fast.
It's completely no fault of yours.

First of all you are NOT stupid!.Just trusting honest people who were trying to make their lives a little easier.You need to speak to a Solicitor ASAP!!.I think most people in the Building Trade ,are to be approached with caution TBH!.I would imagine that with this sort of money there must be some kind or redress surely!.Keeping all the receipts is wise also .The BBC "RogueTraders "may be worth contacting them .You only have to be on for a little while and they have a lot of successful cases.Or as someone else said DIY SOS.Make sure you choose a good solicitor( ask around for referrals or contact The Law Society for names .Good Luck and I hope it all gets sorted out quickly for you(flowers)

Thanks - I've asked on the legal board and it seems that a limited company means that even though the individual has spent the money I can't persue him for it, only the ltd company and if the company has no assets then I'm stuffed.

Seems really unfair as I know the builder owns two very expensive properties, and is driving a car worth around £30000.

He's defrauded me perfectly legally it seems.

Get legal advice ASAP. I wonder if he owns his house and if it would be possible for you to put a legal charge on it if he's a director of the building company. Then the debt becomes secured and you could actually force a sale of his house to recoup your money and interest. If it's possible to put the charge on in the first place. @CrotchetyQuaver - apparently as it's a limited company there is no way to take the directors or shareholders to court. I don't know why, but it seems like it's a get out clause for unscrupulous builders to do as they please Hmm

I've found this list and I think it does/will cover some of the money I've paid him, because he definitely hasn't used it all on company stuff, I'm pretty sure I've paid partly for personal stuff seeing as he hasn't paid the tradesmen, hoping the solicitor can advise when I speak to her on Monday.

This is one of those things that whilst it’s not a legal fraud, it’s very fucking easy for them to do it. However he lives locally, he’s doing business locally,, you need to shame him into either giving you some of the money back or completing the work. This is where local media might be a help. Even just the paper where all you need to perfect is your sad face.

Makes me angry and sad and all sorts, but the fact that this is allowed to happen is nuts! The company was only set up late last year so if it folds so soon surely that's suspect?

Looks like he created the limited company, ripped a few people off then folds it. Although he hasn't folded it yet it'll probably be his next move.

This is such a hideous legal loophole, where companies can be folded and reopened repeatedly. It’s appalling. They get away with it many times before anyone does anything.

Keep going with the solicitor. Threaten to go to the media (do you have a full name for him and is it real), he can always start a new company but having his picture in the press will make it very hard to pull the same thing on someone else. You could also contact local building supplies places and find out if they know him. Reputable builders should have lines of credit with them, so they shouldn’t need to be paid for materials until you have them.

I’m so sorry, we’ve had an issue with a tradesman not finishing a job recently but nothing like this amount. You must be so upset.

Make sure you give your solicitor the info in your last post. Whilst you can’t pursue a director for the debts of a company if the company has been set up purposefully to defraud people it might be different so worth getting a legal view. At least if gets convicted for fraud he can’t do it again although I realise that probably doesn’t help you much.

I do have a real name for him and his partner who is the company secretary, its mind blowing to think someone would do this a few miles away from where they live - bonkers!

I will definitely continue with the legal route which may scare him into doing something, again I don't have pots of cash to spare but I've got to give it a go, no idea how much the quantity surveyor will cost and what do I do if he just ignores all correspondence?
