Does anyone have any experience of balconies and planning permission? Epxperience of a situation similar to mine?

My neighbours have put this up without planning permission. I have reported it and they have to put a retrospective planning application in.

The photo looking outside is the view from my bedroom window. gives them a direct view into my bedroom and even onto my landing. The external photo shows the vastness of it and the ridiculous amount of overlooking.

To me, there is no way they should get planning permission for this. but I hear of such weird decisions by councils. I have already drafted my objection (the planning application is meant to be in by end of this week) but I am very worried that they may get approval.

Wooo congratulations @Morley19, great outcome. They won’t take it any further the cost would in doing so would not be worth it and it wouldn’t necessarily change the outcome.

Glad to hear of your update @Morley19 You have inspired me to contact our council, just to ask about our situation. Slightly different as it was years ago plus the build is a council venture....

Photo 1 is of the refused plans and photo 2 from the permitted with conditions plans.

Incidentally one of the conditions was for the huge net to stop the rugby balls hitting any of the flats facing it to be taken down when not in use. They haven't been removed once in the time we've been here, and are quite weather worn.

Gosh this has so many twists and turns to it.
BB can't buy new house unless they can sell theirs first?
Is the one they are buying with the same estate agent they are trying to sell through?

Would love to win the lottery and buy the house next door, but only after I had bulldozed "them over the back" to us, Balcony Bastards 2.
(Who did get planning permission, much to the shock of ourselves and the Parish Council).

We are stuck until BB2 is built and we have planted a forest along the perimeter fence. We may add a watchtower and some snipers, and wait for the enforcement notice before we take it all down.

I'm so glad that you have had a more positive outcome, fingers crossed that this all comes good as soon as possible.

So sorry that your BBs won their case, just so wrong. I don’t know what these councils are thinking. Bet they woukdn’t make the same decision if it was their house.

If there was any justice in the world my BBs and yours would end up neighbours!

What happens when/if they're still there 29 days from the ruling? Sorry to put a downer on it but they clearly have no respect or understanding of regulations.
Hopefully they can actually see that it will prevent them selling, but when someone's as thick as custard..........

I have emailed the council for clarification but my understanding is that the 28 days stipulated in the EN kicks in when the appeal is denied (can any planners confirm this?)

If so, and they don’t comply, I will just have to report them to the council. And continue to report until the council take action.

They obviously want to sell their house and realise that a planning dispute is not going to help.

Of course they might just be storing the railings in the garage and will be including them in the price of the house so that the new owners can re-erect it...

So glad for you - and also shows that they clearly want to sell 👍🏻 which is the best news. If they intended on staying they would have prob carried on fighting / delaying.

Am sure they are next door right now muttering about how you have driven them out and feeling like the victîms in this - although it is clear they were never the victims Smile.

Let’s now hope for a quick sale and lovely new neighbors

Yes they defo see themselves as the victims. Which is just madness. They brought all this on themselves by not giving a stuff about anyone but themselves and exempting themselves from the planning laws if the land. All so unnecessary

I would like to think they will learn something from this. But I doubt. They will never see that they were in the wrong.
