Balcony and planning permission *images removed by MNHQ at OP's request*

Does anyone have any experience of balconies and planning permission? Epxperience of a situation similar to mine?

My neighbours have put this up without planning permission. I have reported it and they have to put a retrospective planning application in.

The photo looking outside is the view from my bedroom window. gives them a direct view into my bedroom and even onto my landing. The external photo shows the vastness of it and the ridiculous amount of overlooking.

To me, there is no way they should get planning permission for this. but I hear of such weird decisions by councils. I have already drafted my objection (the planning application is meant to be in by end of this week) but I am very worried that they may get approval.

I wish you were all here so we could go to the pub together and celebrate! I feel like I know you all!

Can’t believe today has finally come. Justice does prevail sometimes.

This balcony is just one of the things these people to me. Some of the others are far more personal. So this really is great news. They are vile, selfish, arrogant, nasty people.

If anyone does have any ideas about how to progress more the building regs issue when the railings come down that would be greatly appreciated

On Monday it will be a year since I started this thread!

Took a while but got there in the end. My neighbours underestimated me and thought they could trample all over me!

Estate Agent is well aware of the position

Hi yes, after they had listed their house for sale, and due to some info I had given, it became easily identifiable so I was advised to remove photos

justilou1 - yes I know what you mean but we literally don't speak anymore (haven't done for over 1 1/2 years) so they probably won't. Having said that, I actually hope they do say something like that to me as it will be met with a very short, sharp response about how THEY didn't give a flying f**k about hugely reducing the value of MY house when they put that monstrosity up! what goes around comes around...…

Can I ask a question.....

The EA is well aware of the position - I told them last week that it was in serious dispute, had an EN notice against it and we were awaiting the outcome of the appeal. They just said 'Itw as something they would need to discuss with the vendors'

I told them yesterday that they had lost their appeal and tthat the balcony now legally had to be removed within 28 days. I said that I now strongly felt they were advertising the property in a very misleading way - there are 4 photos that show the balcony (one a close up) and in the narrative for the bedroom, it refers to 'French doors leading to a balcony.' when I spoke to them yesterday they said that 'the vendors were making preparations for this.' whatever that means

The EA hasn't changed their advertising of the property at all. Are they not being negligent now?

I have just been told that my neighbours has told another neighbour that they are taking the appeal to the High Court?!

I can't see it (sounds like just bravado) but I might now have that to deal with.

I assume that would cost them thousands?

Also, what are the chances a High Court would override this?

If they do take it to the High Court I assume that is another very length process? also, what happens to the EN? Does that sit waiting in the background again whilst that process is happening?
