Indemnity insurance

Our house is ex council. We were council tennants and a housing association bought the stock, we therefore became housing association tennants. When the HA took over they did some improvements, in our case a new front door and double glazed windows.

Since then we have bought the property and are now selling it. The buyers solicitor has asked for indemnity insurance on the windows as we do not have a guarantee for the works. Is this really fair of them to ask this?

I suspect that it is not a guarantee they are after, but a FENSA certificate [[https://www.fensa.org.uk/]] or a building regs certificate.

I would have thought this would have been something your solicitor/conveyancer would have checked when you purchased the property.

It's not likely to be terribly expensive, and is a fairly common request, so yes, fair of them to ask.

We did ask at the time of purchase and they said there would not provide anything.

I would just buy the indemnity - its a small cost in the scheme of things and this seems to be the answer to a lot of things during the sake and purchase of houses. 20 years ago this sort of thing never came up. Its not worth holding up the sale and possibly losing your buyer or purchase for.

An indemnity policy isn't much - and personally I'd much rather buy that than risk a sale falling through - Your solicitors didn't pick up on this when you bought it though?

We had new Windows put in by our builder who was not FENSA registered and had to buy an indemnity insurance when we sold. It’s just one of those things and not your buyers fault. It’s not worth arguing over in the grand scheme of things even if it feels unfair.
