WDYD when you've completed and vendors are still in?

So we've finally completed on our property. We're waiting to get the keys but vendors are saying there is an issue with their removal service and can't move out today. Solicitor says they have to. They say they can't. Literally what do you do?

This happened to us. We went round and rang on the door. When they answered it I slipped past them and sat down in the front room with a bag packed for a siege. Like you we weren't moving straight in so I think they thought they could just hang out there until they felt like moving.

But their things being in the house doesn't stop them from staying elsewhere! I'm fuming on your behalf. Not a chance I'd be happy letting them stay until Monday. How the hell did they complete and keep the keys??

At the very least you should be going round there, keys or no keys, to confirm things are boxed up. By just saying fine, giving them 3 days and entering rental agreement, they will see no urgency.
With or without keys, the house is yours!

They might not be able to move their stuff, but there is absolutely no way they should be staying in the house and you having no keys.

I'd check with your mortgage company ASAP as I'm sure there are rules against this and you could have real problems.

It's been a while since I last moved but after our offer was accepted the vendors turned into a complete nightmare to the point where out solicitor said we had to exchange and complete in the same day. She also wouldn't put anything through until they had gone and sent a locksmith round to follow them out, which they were billed for.

Yeah honestly op, I think you are setting yourself up for massive problems. Come Monday, what happens if they don't go? Because, as I said up thread, my friend had this happen and it took a few weeks all told.

Your house insurance won't pay out if they haven't been informed that you're not the occupants.
Also if there is anyone else lodging at the property that can invalidate all sorts if covers and perils.

I agree ,you are making a massive mistake , they should be out and not in possession of any keys - they can then pay you storage fees for their belongings until Monday whilst they go stay with family / friends / hotel and someone meets them at the house on Monday to let them in to remove their belongings whilst supervised .

You solicitor should serve a failure to complete notice. There should be a clause about this in the contract. It means you can claim all your costs from them.

This happened to us last year when funds got stuck in the banking system and we could not complete. Luckily we already had a hotel booked for the Thursday night but our movers had to take our stuff back to the depot. The bank and our purchasers solicitors had to pay the costs.

This good people is why you should never move on a Friday. Our vendors costs had to be met by the bank and our purchasers solicitors too. It was very stressful.

You need your solicitor on this and they should be paying for it! Call around some removal companies find some that are available and hand over the details. This is extremely dodgy!

Unless you have a buy to let mortgage on the property I can't imagine the mortgage company would be too happy. Your insurance will be invalid!

As you are now the legal owner YOU will be legally responsible if anything hppens to them or their belongings as you are allowing them to remain in situ.Get your solicitor to issue the necessary legal orders so you are covered by insurance.. And yes if they still do not move the police will have to be called.

The rent charge better be something like £1k a day to compensate you for the huge risks you are taking re mortgage and insurance
