WDYD when you've completed and vendors are still in?

So we've finally completed on our property. We're waiting to get the keys but vendors are saying there is an issue with their removal service and can't move out today. Solicitor says they have to. They say they can't. Literally what do you do?

I had this years ago, let them stay another few days as felt sorry for them... had to get quite aggressive to get them to go in the end, good luck op. X

We had a bit of a luckier escape when we bought this house. We completed at 2:30 and when I got there at 3:30 the elderly owner was sat in kitchen with a cup of tea deciding what to pack first! The had moved a lot of stuff out so was mostly kitchen stuff and suitcases but by 7pm when they decided they needed dinner there was still lots left. They went off for food, their cats wandered in cat flap at 9 and we were debating if they'd come back for rest and cats when at 10:30 they came back and cleared everything!

Many years ago we bought a house and when we arrived the last owner was raking a leisurely bath. When they finally left I realised they did not plan to move the huge van in the driveway 'it's our son's and he's in prison'. It stayed there for several months til he was finally released and turned up with a bunch of men in case we'd dared to try and move it...

I really hope for your sake that you haven't called the money rent or made any mention of rent or tenants.

You could end up with them being there for 6 months.

You have to refer to this as a fee. Or penalty. Never as rent. Tenants have rights. LOTS of rights.

Oooft, I'd have told them they had to move on the Thursday at completion! It's stories of awkward vendors and crap solicitors that really puts me off moving but we have to . Fortunately for us DFiL is a conveyancing solicitor so we're unlikely to have too many issues hopes beyond hope

Am I completely naive or are there always moving vans available providing you're willing to pay the price? So if it's too big for 1 man with a van you get 4 or 5. Or someone from 100 miles away with a big enough lorry but pay the out of area price? Clearly they saved money at your expense.

We told them that they would have to pay for our stuff to be put into storage and brought back (our removal van couldn't hang around) plus overnight accommodation for us all in a hotel.....they got out pretty quickly. .....

However when we bought our current house, we agreed the sale when I was 39.5 weeks pregnant with dc1 and moved the day she was 5 weeks old. Except we'd completed a good 5 days previously and the owner of our old house was happy for us to stay for a week or so, no charges... There were no issues but I hadn't thought of the insurance. We were just laying carpets etc (To be clear, we part exchanged, and the guy had already part exchanged a bigger and more valuable house for the one we bought from him- he'd never lived there. So we took their house which was obviously vacant and they were going to rent ours out but old have a delay til they found tenants) So I hope yours will go smoothly on Monday ignoring the fact ours was agreed well in advance and there were no worries over our moving

OP if they're not out at 9am on Monday I'd be calling ALL the local solicitors until I found one that would help me. Your kindness has put you in a horrible position now re rent, mortgage, insurance. You'll need legal help if they take the piss.

I would be there on Monday, & cancel the phone/internet & electricity if necessary. So forcing the issue

It is you house, I would camp there. as for temporary renting. bad idea. if they lock you out, & even if you break a window to get in, they have rights & can call the police.

If you're reading OP, I would be inclined to pop over today and check they're ready to move tomorrow. Ask then what contingency plans they have in place incase it all goes tits up again. I would be polite but firm.

First thing tomorrow you need to be on their doorstep. If there is no evidence of them moving - like a lorry or they can show you documentation to prove a lorry is arriving imminently you best get down your solicitors pretty sharpish. There is a chance depending how things have been worded this may still be resolvable without all the nightmare scenarios mentioned on this thread. But the longer they remain the bigger the problem.

You need to be rock solid tomorrow. No second chance's no more sympathy for their unfortunate situation. They are moving out tomorrow and you in
If I was in their shoes and genuinely had a removal cock up I think I'd have spent the weekend trying to research solutions alternatives and contingency plans. If they've just sat there planning no alternative like sitting ducks all weekend then they deserved no sympathy or extension. You've already been more than sympathetic at risk to yourself.

So would I, but more to the point I'd have told the EA about everything I was doing so that they could reassure the buyers

I very much hope they've done this, and that it hasn't turned into a situation where OP's got to go there tomorrow, merely hoping they've sorted something out

At the very absolute minimum I'd try and move my stuff into one or two rooms, give keys, move out with a small suitcase and BEG for mercy to get my stuff back.

No way would I trespass in someone's house.

I would ABSOLUTELY try and stealthily enter property and refuse to move. I would not charge a fee in case it was taken as rent. They are not tenants they are thieves.
