Partner denied paternity leave?? Any advice??

Am 38 weeks pregnant & booked in for a planned Caesarian next week & just found out that my partner is not allowed paternity leave. He started a new job last year & is just a week short to qualify for paternity leave. They won't allow him to take unpaid leave either. Has anybody been through this & come out the other side?? He has 3 days of annual leave he can take. We have a 3 year old also. We have no family nearby & they are fairly disinterested anyway. I can't stop crying, I'm most upset about the fact that this special time for us to bond as a family has been taken away from us Sad

Indeed. I'm currently on a career break & didn't even get a MATB1 this time round. DH's work seems to have coped fine.

Dies it work if you split your leave with him or is it still too short?
My employer said they pay the leave but deduct it from my alloance at the end so I'd have to return earlier.
We can't afford it so it's not much use... maybe 2 weeks off with stress?!
I imagine if he's at work knowing you're at home he would be more than a little stressed!

Op, my DH had saved holiday for when DD2 was due (18 years ago so before all the paternity leave etc) but his work then refused to authorise the leave as someone else was due to be off. His boss just told him to go to the GP and explain the circumstances, the GP then signed him off for 2 weeks with stress. We already had a 1 year old and no family to help (my mum had cancer).

I'm sorry but why hasn't he just gone straight to HR? It's his boss that's said no. HR represent the company in this.

He could self certify sick leave for a week, with stress caused by worrying about looking after his family?

You don't have to work for them for a year to be eligible? I thought it was slightly less than that. My dh started a new job last may/June. I had my baby six weeks ago and he was entitled to paternity leave, thoygh not the enhanced pay. And they kegally do not need to see the matb1 form.

You need to have worked 26wks before the 15th week before due date... So 25wks of pregnancy.so as long as you were pregnant at least a few weeks before he started working there surely you qualify?

Ok he started sept, and you are due end may? When in sept did he start? And when is your due date?

He needs to talk to HR. And his union. His boss is being an absolute idiot - this will hardly make him loyal and keen to do his job, will it?
You both need someone who knows their stuff to advise you - ACAS maybe? Your Union? Perhaps post in legal or employment matters?
