Hi, im after some advice...

Im 25 weeks pregnant next Tuesday.

I thought dp had told his work I was pregnant. With the previous dc I don't remember him doing anything apart from just verbally telling his then employer that I was pregnant.

He asked me last night when I'm getting my Mat B1 form, as apparently thats what he needs to hand in, by Tuesday do he can get paid paternity leave.

Im not even in London on Monday & I don't have an appointment with the midwives until im 28 weeks. Can the G.P issue a Mat B1? Im self employed & entitled to the lowest level of help financially so I had decided not to take as little time off as possible- only 2/3 weeks. I work from home & all other dc are at school so i wasn't going to bother applying for Maternity Pay via the government as it would only be a few weeks & not worth the hassle!

So who issues a Mat B1 & if dp doesn't hand it in by Tuesday-when I will be 25 weeks, will he lose the right to paid Paternity Leave?

You are supposed to request paternity leave before week 25, yes, and the employer can ask for matb1 as proof. GP can issue it, as can midwife or consultant.

That gives me til Monday. Dp is on a late shift. Can the employer refuse to pay the paternity leave after this date.

Honestly dp is such a twit I have to sort everything! !

DH wasn't asked for this either time (mind you, small start up with mates so doesn't really count!) I got mine from the GP both times. Sure if you explain you need it quite urgently they can help. They would be ridiculously jobs worth to cause issues with DP time off based on this, I don't think they'd really be able to argue their case TBH. Good luck

Uh oh - sorry to hijack but my DP's work are aware that I'm pg I believe but he hasn't even enquired about pat leave yet and I'm 30 weeks!! Oops. I'm guessing he needs to get his skates on? Can they refuse it?

Oh you wouldn't believe dp's employers.

He took an extra day of bereavement leave when his mum died as he only got 3 days paid leave so the day was unpaid.

He was called into the managers office & 'warned about attendance' !

Large company with hideous attuide to employees. As a man in his mid 40's who has no formal qualifications he doesn't have much choice but to put up with it...

They can refuse if you ask after a certain point or refuse to give you paid leave - i can't remember hiw many weeks it is. If they are reasonable surely they will accept a written request with Mat1b to follow.

I didn't have a midwife appointment in between 20 weeks and 25 weeks so I phoned and they prepared it and left it at reception for me to pick up. They don't need to see you to issue it.

Who did you call noble the mw or gp?

I had an appointment at 16 wks & next one i will be 28 weeks as its my 6th.

I've only seen mw at a local children centre so I will ring my gp Monday morning first thing.

Im so annoyed with my lazy arse dp I should leave it & he can take the time off without being paid!!

In theory they can refuse on the grounds they have not had enough notice. Most employers would grant it anyway but you run the risk of not being able to take the leave until later.

I thought so.

To be very honest dp has never been much use when he's been on paternity leave with other dc. Im so annoyed with him for not organising this- it turns out hes known for months that his company ask for the Mat B1 to organise paternity leave.

He doesn't want me to have a home birth as its not 'convenient'. So im going to end up on my own in hospital.

Im only off work for 3 weeks myself as his job so crap.... GRRRR He makes me so bloody angry!!!

The form suggests that you need to complete it at least 28 days before paternity leave to get it paid.

I think the 25 weeks thing is to get the leave organised, then paying for it can be sorted later.

So if he is late, that might just mean he takes his leave later.

Sorry, lagoon is right. They can insist on it in writing but you can do that with the sc3.

Thanks. I will download it tonight. Call my GP first thing Monday to see if I can get the Mat B1 organised.

If I can't, I will get dp to hand the form in & Mat B1 asap.

Unless the rules have changed in the last year the matb1 does not need to be provided and they shouldn't really ask for it.

Dr told me at 25 week appointment they couldn't do me one! Had a major panic as needed to hand it in the day after and had to collect from midwives at my local hospital.

Like i said earlier they dont need matb1.

Just hand form in. You could always copy front of notes with edoc on.it
