My petition:

Charge non-resident parents who evade child support payments with child neglect.

Current legislation does not recognise non-payment of child support as neglect. After a year of non-compliance separate criminal charges should be brought against such non-resident parents for child neglect. Resident parents should also be able to prosecute non-compliant NRP for financial abuse.

Figures from 2011 indicate that 95.2% of parents who approached the Child Support Agency in order to access their legal entitlement for child maintenance were female. The failure to collect rates are astonishing. It is therefore a gender inequality issue. This social injustice needs to be urgently addressed.The far reaching repercussions have to be legally recognised for both the parent with care and the child/ren when one parent fails to support their child/ren. It is neglect and abuse.

Obviously it would need to be well proven so that the RP who deny access don't get to manipulate the rule but where this is evidence...

I've just joined Mumsnet in order to respond to this thread, and I don't know how it works, i.e. whether any of you who've already posted will see my message because it hasn't been posted on for over a year.

Kerry Ann, I just came across your petition, and I'm so sorry you didn't get enough signatures. I agree with it wholeheartedly.

I have been working all summer on preparing my case to seek judicial review against DWP for failing to enforce my son's child maintenance since 2010. I will seek compensation equal to the full amount owed (over £16,000) for maladministration and wilful refusal or culpable neglect of DWP to carry out its duty.

I'll need to submit my application within the next few weeks. Does anyone have a good case ready to potentially join with me as a class action? You don't need to have been to the Independent Case Examiner or the Parliamentary and Health Ombudsman, you just needs to have exhausted the Child Maintenance Group complaints procedure. I will probably have to do it as a Litigant in Person, but I intend to approach James Pirrie to ask whether he would be willing to assist or advise on a pro bono basis, and I imagine that he might be more interested if there were a few of us.

Please reply if you're interested.
