Supermarket Fall

ChocolateCakeLuver · 23/02/2024 15:30

This morning I popped into my local supermarket & my son ended up having a fall on a large puddle of juice. Once I spoke to a member of staff they had explained how the puddle happened an hour before the incident and should have been cleaned up, however will be done right away which it was. This has resulted in my son getting quite a big bruise on his bottom.
I emailed the head office right away and they have replied to say they will be investigating this & would like to offer a good will gesture. What would be a reasonable amount to accept? If I should accept it? Should I make a complaint anywhere else?

Tia

Poor DS! What I’d want most is an assurance that practices have changed so that it hopefully won’t happen again so no one else would be hurt because it could have been awful if it was an old person! Then as far as good will goes I’d be happy with a gift voucher that meant DS could choose a toy and then I’d want to forget about it and move on.

This is something I bought up in my original email to them as if it was an elderly person it could have been much worse. Thank you I will make sure to mention things should be changed to prevent this happening again to anyone else.

I'd be interested to know what they offer you too. I'd assume less than £20.

I assume DS is a toddler? As someone else suggested, buy him a gift and forget it. Ridiculous that staff admitted it had been on the floor an hour though and no one had cleaned it, or at the very least, put a sign!

I think you should have filled in an accident report form at the store. I hope your DS is okay.

BlunderMifflin · 23/02/2024 16:12

You could sue them for this. I'm not saying to do that! But they admitted they were aware of it for an HOUR and did nothing about it. What if it had been an elderly person who would've been more likely to break a bone? What if your ds had hit his head on the hard floor? Your poor ds is lucky he only has a bruise, it could've been a lot worse. I wouldn't sue them over it myself but I would be kicking up a bit of a stink with head office. They absolutely shouldn't be fobbing you off with a small gift voucher.

ChocolateCakeLuver · 23/02/2024 18:36

I’ve just had another update from the HO of the supermarket and they have offered £100 gift card for the supermarket.
what would you do, accept?
They have also mentioned they will be training this particular store in health & safety on Sunday after the store closes and this situation will be bought up.

I’d accept the £100 voucher. You can’t sue for what might have happened and there is no loss of earnings etc to recuperate.

purpleme12 · 23/02/2024 18:42

Yes I would accept £100 voucher!

DontCallMeKidDontCallMeBaby · 23/02/2024 18:42

I would absolutely accept it. I’m assuming you’re in the uk, if you are compensation is usually paid to cover loss and or damages caused. Unless you’re anticipating your ds to need potentially costly treatment (physiotherapy etc), which it doesn’t sound like, I can’t see how you’d be entitled to anymore.

PlipPlopChoo · 23/02/2024 19:00

£100 is a fair result. Most boys will probably have bigger bumps and knock than that each year.

I’d accept the gift card and head office will be keeping a close eye on that store and probably issue reminders to all stores

I think that’s a really good result, especially the training part. Let your DS choose something nice and hopefully it’ll go a way to making him feel better too.

mathanxiety · 23/02/2024 19:19

Yes! Accept the £100.

LizFromMotherland · 23/02/2024 19:21

I don't really know what you mean by 'accept'?

If you don't accept it, what do you think's going to happen? Are you going to take them to court instead?

Elecrricmaracas · 23/02/2024 19:23

I think if he'd had a life changing injury you'd be right to sue them but £100 for a bump isn't to be sniffed at!

Pippitty · 23/02/2024 19:30

£100 for a bruise? Which supermarket is it please? It's well worth me waiting in there all day for a puddle of juice...

Not at all! I was thinking more on do I accept it or just the training is enough. I emailed them due to being concerned if an elderly person had a fall what the outcome could be, not for compensation. My child is fine except from a bruise on his bottom.

yes the compensation they have offered is significant & would make him very happy by splashing out on a visit to smyths as I can use the gift card at the supermarket.

How old is your son?!

itsjustajobera · 23/02/2024 19:44

I wonder why they didn't put up a yellow sign.

nc22124 · 23/02/2024 19:57

I can't understand why you wouldn't accept it. They screwed up, your son got injured, they're offering a goodwill gesture which you feel is (more than) sufficient under the circumstances. Case closed, no?
