i bought some dvds from there. a new boxset as i understood. i won and paid for the item, yet when i received them they were just copies thrown into a jiffy bag. I have emailed him twice now asking for my money back and recieved no reply. I have alerted ebay of this too. This was last week. What else can I do? I know I have probably lost my (hard saved for the past year) money. It was supposed to be a present but I can't give them copies!!! How long should I leave it before I leave negative feedback on him?

I have to say that from the description I would have guessed they were not genuine dvds. no genuine dvd listing would contain the phrase "this collection contains menus" as if it was non-standard. buyer beware basically.

having said that, it is obviously piracy and illegal so you have a case there.

advocateofthedevil · 16/05/2005 20:07

unless he's bidding on them himself to inflate the price he's not actually charging excessive prices for them it's just that people are willing to pay excessive amounts for them. bidding started at £1. and his name isn't spacko that's the charming name of the person who left his first feedback.

Newbarnsleygirl · 16/05/2005 20:11

Thinking about it, if he was bidding on it himself at that price you wouldn't expect copies would you.
Not when you can get them on the market for a tenner

tamum · 16/05/2005 20:13

It looks like an amazingly dodgy listing, and I'm sorry, but paying anything like that much was a big mistake. The pictures say it all. Do report him, they should come down hard on pirating, but learn from it too. Definitely try and get a refund. If you paid by Paypal could you do a chargeback?

onlyjoking9329 · 16/05/2005 21:24

looks like he has sold at least 3 of these one went for 112 quid, looks like hes making a few quid i noticed he has brought a car for 3,600, but not given or recieved feedback so i think he is also a shill bidder, gets his mates to bid up his auctions and they do the same for him, i would ask him for a refund if no joy report and do a chargeback

Hulababy · 16/05/2005 21:31

Think someone has already said it - but if you look at his feedback - there is one neutral one - same item. Feedback says that he returned the item.

Can you use this to help you?

Hulababy · 16/05/2005 21:32

Definitely do down the illegal route - as I think you have a better chance that way.

Gwenick · 16/05/2005 22:57

well I just got a reply from my question ( Hi, was just wondering whether this is a box set - and whether it's still sealed? Also how many Discs and are they new copies, or new DVD's)

His reply..........

ateam will never be released as 98 episodes in the shops sorry

!!!!

kid · 16/05/2005 23:01

see he isn't willing to actually admit they are copies! Still at least he replied! If Titania emails him now, she knows he is online and will get her email straight away.
I wonder if she sent it yet?

Gwenick · 16/05/2005 23:05

hmmm very odd........

I've just receieved ANOTHER answer to my question - but from a different email address.

In the mean time had sent a reply to them at the first addy asking for more details.....which has bounced! "Reason: Administrative prohibition - unable to validate recipient"

I emailed him AGAIN with this....

Hello. This is the third email I have sent you now. Unless I recieve a response within the next 24 hours I am afraid I will have no other option but to take this matter further. Please could you refund my money. I notice that you refunded somone else for the same item a while ago so it shouldn't be a problem. Thank you.

I have also contacted paypal and ebay about it.
Will just wait and see what happens now I guess. Thanks ladies.

It infuriates me when people leave negative feedback in retaliation I always leave feedback when people pay as I figure they have upheld their end of the deal and it's now down to me to deliver the goods as described.

Hope this gets sorted for you Titania

Gwenick · 17/05/2005 11:12

well I now notice that he's made his feedback private - so no-one can see what people have said.......

Tissy · 17/05/2005 11:38

AND all the bidders for his current auction are private too. Agree he's probably bumping up the price artificially.

advocateofthedevil · 17/05/2005 11:59

Titania, post this in the ebay forums. you'll get more advice there which is possibly more helpful. not that this isn't helpful but the ebay forums tend to know all the rules and stuff about getting refunds.

advocateofthedevil · 17/05/2005 12:01

Email ebay and they'll suspend his account see here

Titania · 17/05/2005 12:02

thank you.

ans here's something else for you to do

advocateofthedevil · 17/05/2005 12:04

how did you pay? did I miss that? if credit card, reclaim from the credit card company although if you've paid with ccard via paypal they may refuse as echnically the transaction was with paypal not the dodgy trader. ditto with switch etc.

slartibardfast · 17/05/2005 12:53

As aot-devil says, you have Eba's Standard payment protection, which ought to help a bit.

including
"The item is not authentic and was not disclosed as such. For example, if a fake or pirated item that was advertised as authentic or a completely different or inferior brand of a similar product;"

On the credit card - the txn is less than £100, so you couldn't extract the money from them under Consumer Credit legislation.

Good luck - keep us posted - it's ebay people like that who undermine a good service - and seller is busy defrauding other people with the same item as we write this.

advocateofthedevil · 17/05/2005 12:57

slartibardfast, dh got an amount less than £100 refunded by his credit card co when a website he ordered from went bust. always worth a try.

Titania · 17/05/2005 12:57

i did it through paypal. the money went straight from my bank account into my paypal acount then onto him. I have emailed ebay and paypal about it. I have given him 24 hours before I do anything else, pointing out that he refunded someone else so he should to the same for me without a problem
