people have been talking on pregnancy boards about accruing holiday throughout maternity leave and it seems that it is new legislation to apply to everyone.

Of course it will be different for teachers due to number of days holiday per year. But does it apply in any way at all?
I hae written to NUT ut no response yet....

no it didn't count for me. unfortunate as our holidays are set. I would be interested in what the union says though as i 'lost'6 weeks holidays- although i gave my return to work date as the first day of the summer holidays so was paid for the summer

I've been thinking about this popsy - my dates work out so that I would like to take exactly one term off. My ideal start and end dates for maternity leave would be the first & last days of term - can I do that or do I have to finish at the end of one term and go back on 1st September instead of 1st day of summer hols?

I was on mt over Christmas/New Year and 'got' 3 1/2 days holiday which I tagged onto my leave. It was notified in a letter when I told them I was returning. Meant I only had to do 2 weeks before the summer break-up.

Fisil - teh start date - that is fine cos you say you start it on the date when you ought to return back to school - i am doing that after xmas.
But you phsically have to go back to work to end your mat leave....so I might go back for a week before summer.......unless i can accrue a weeks hols and tag it on the end of my maternity so theoretically back at work on full pay but not there cos on holiday.......

You can definitely start mat leave on the first day of a new term (get half term for free), and go back on the first day of a holiday too. I actually went back for last 2 days before summer, as I wanted to ease myself in a bit - grandparents did childcare those days - aand to get info about coming year.

not any more as dd is 3 but did have so i might be able to contribute? Was f/t before dd but have been p/t ever since (0.6 - 3 days a week).

hula - i was told that i couldnt end my aternity on the first day of a holiday last time.....i went back one day before xmas!!! cheeky I am!

i finished work on the 3rd jan 2004- but i wasn't in work over the hols was i- then i had 2 weeks unpaid mat leave before summer hols and returned to work on the 19th july 2004 actually retuning to work on the 6th sept ( i only work mon and tues so first mon in sept was 6th)- so i had 2 weeks unpaid but was actually off for 8 1/2 months... worked out well for me- i lost 2 half terms and easter (sorry lied before then-it was only 4 weeks i lost) bit of a bummer for you yorkiegirl

School told me that too. But it is wrong. Union put me right, and I then spoke direct to the LEA who had to agree But then I changed my mind anyway and went back for 2 days.

popsycal- yes I am. I didn't realise that I was due the days and when I checked it was because I was on paid mt over the xmas hols. I think it's to do with when you are on paid leave rather than gov mat pay.

Contractual Rights and Remuneration
An employee on maternity leave preserves her continuity of employment and continues to be regarded in law as an employee. During the 26 weeks of Ordinary Maternity Leave a woman is entitled to receive all her contractual rights except remuneration (remuneration includes wages and salary and may include other things).

Contractual rights include pension rights, holiday entitlement and other benefits such as a company car. It is not clear from the legislation whether other forms of 'pay' (such as bonuses, subsidies etc.) are regarded as 'contractual rights' or 'remuneration'.

It is up to the employer to make this clear in an employee?s terms and conditions but it would be advisable to give an employee a proportion of any salary related bonuses earned during the period before she went on leave.

While on maternity leave most employees will be entitled to receive Statutory Maternity Pay (paid and reclaimed by the employer) or Maternity Allowance (claimed by employee from Department of Social Security).

Accrual of holiday during AML
Holiday accrues as contractual during the 26 weeks of ordinary maternity leave. During additional maternity leave the employee will accrue holiday under the Working Time Regulations. This entitles all employees to 20 days holiday per year. You may find it easier to allow the employee to continue accruing holidays as laid down in her contract rather than attempting to administer two systems

And for dd I went back in the middle of the summer holidays - you can go back when you like even if its in the holidays.

And I went back before my 26 weeks were up even in the middle of the summer holidays..I needed the money.
