that bloody twat who bought our house is STILL pushing for comepnsation. Would have posted on the other thread but I cant find ithelp

anyway he has took photos of what I dont know? they look very silly to me gawd please tell me there are some nice people left in this world!

FIO2 - found your previous thread and had a read...the guy is obviously an arse....I think as long as you don't leave anything additional in the garden (contents of the attic! etc.) he hasn't a leg to stand on. He had a survey done and saw the property. If for example, you had agreed to move all furniture and decided to leave your manky threepiece suite he would be able to get you to pay to move it (this happened to a friend of mine..). What did he take photos of?

the waterbutts which i said i was leaving. and some crap in the outhouse, which the removals must have left. he has made the photos seem alot lot worse. he took a photo of some cardboard on the yard?

sorry fio, I agree with blackduck I don't think he has much of a case. Try not to let it wind you up. It would cost him money to take you to court and he sounds like too much of a tight arse to do that unless he is 100% sure he would win which is not likely imo.

Could you bear to go round and pick up the 'crap' the removal guys left (or get them to do it!) that way you haven't left anything you said you wouldn't leave. Did he agree to have the waterbutts?

God if I went down this route I could get my whole garden re-done - they left us at least three old christmas trees and god knows what other rubbish......!

How much could he possibly hope to be awarded in compensation for such trivial matters? Surely it wouldn't be worth his while to pursue it?

some people are just like this - they will try it on....I agree with everyone here, simply say you look forward to seeing him in court and that you have put the matter in the hands of your solicitors and will not be corresponding with him from here on in..

Also, if he goes via the small claims court, you will have the right to have the case heard in your local court. I expect that will cost him a bit in travel expenses and accomodation if he lives a long way from you. Then of course there are the court fees that he has to pay to bring the case in the first place.

ahha coppertop can i specify we have the case here? that would be great! I am going for legal aid via the CAB because my daughter is severly disabled, I think that qualifies?

my original solicitor was charging 135quid an hour [angru] as if i can afford it!!!!

i feel sorry for his poor wife you would HE owned the house and in fact he only refers to my husband as if I didnt own it. what a twonk......i have had a drink and i hat him@!

I had to look into all the small claims stuff recently (chasing a bad debt). IIRC he would send his claim to the court and then they pass it on to you. You can then deny the claim and ask to have the case heard at your local court. I think the idea is that this stops you from having to pay out travel expenses etc when no case has been proved. If he wanted to he could claim back reasonable travel expenses if he won. The court sets a date and you can just represent yourself, so you wouldn't even need a solicitor.
